That you let this take 3 YEARS to play out it absurd an foolish. That stated, the complexity this causes will likely result in you paying for legal fees out of pocket to sort all this out as best can be done at this point.

If you have a heart condition and can't deal with stress and need your car for work then you need to make a better effort to pay your car bill on time and not have it get repod. This all occurred because you breached your agreement so no they will not be obligated to offer you a rental at thier expense. You need to be happy they didnt accelrate the loan and demand full payment of the total loan value. You need to focus on working with them to reurn the car in a reasonable time and if need be hirin a lawyer to helo that happen. ... Read More

Unless there is some agreement in writing that the carpet would be new, this is not likely a legal issue. As to the existence of "painters" living in the unit prior to you, this is of ZERO consequence as by definintion somone else always lived in an apartment before you. As to the fleas you can hire a lawyer to do a 7 day letter and if the LL doesnt take reasonble action to correct thefleas, then you can terminate the lease. If you are eleigible you can ask local legal aid if they can help you with the letter. ... Read More

How binding is a separation agreement

Answered 9 years and 10 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
You can't have your cake and eat it too. If you want to preserve any right or claims you may have, you dont sign separation agree emtn and you don't take the money. If you sign, generally you are bound, and it will obviously be slanted in thier favor, thats what they are buying from you for the money they are paying you. ... Read More

First and foremost, you should not be suing anyone over contract disputes with businesses pro-se. Its a reciepe for disaster. If you have a claim worthy of filing suit over, its worthy of hiring a lawyer to handle a court case.

Something dramatically missing here. A settlement check and a loan have nothing to do with each other unless you are trying to stiff your uncle out of the money he loaned you and he claims a lien on the settlement. YOu will need to sit down with your injury lawyer to sort this out or hire separate contract counsel. ... Read More

Likely not. Changing words is technically a counter offer. If they dont accept you have no deal.

The failing of University of Google Law School. Where did you get that bunk. Its CLEARLY not a Florida Statute or Admin Rule from the FDOI. There is not much to do. The dealer is not rquired "to help you" because your poor or on disability, when you car breaks. If you dont pay the money owed, they will likely get a judgment against you otherwise. Whether they can collect the money of course is a different issue.

what are my rights

Answered 10 years ago by W Chase Carpenter (Unclaimed Profile)   |   1 Answer
I’m certainly sorry to hear that – that’s very frustrating, for sure.  The answer isn’t as straightforward as it may seem.  Without reviewing the contract, I can only provide some direction based on the minimal information I have.  In my experience, most property managers/rental brokers will have a provision addressing the issue of double-booking or, at least, the issue of needing to cancel on their side and what remedies are available.  It sounds like your argument’s strength is that the replacement unit is smaller.  However, the other factors you mentioned are not inconsequential (i.e. special trip, too late to change travel plans, etc.).  Unfortunately, I can’t say for sure the exact strengths and weaknesses of a potential action without reviewing the contract and getting more details, but if this poses a significant issue to your vacation, and you are interested in what your legal options are, I’d say it would be worth having a consultation with an attorney (particularly one that practices in breach of contract litigation).... This needs to be reviewed by legal counsel to determine whether this is proper and if not, what should be done about it. This sounds like your daughter breached the lease, and what she owes simply needs to be confirmed.

Ummmm yeeeaaaahhh. If you signed a plea agreement, there are usually a variety of "fail safes" imposed to ensure that you made your decision voluntarily and werent "coereced" whcih short of an actual gun to your head is near impossible to support. Blaming the lawyer after the fact is usually a non-starter. Unless you have a pile of money to devote to the issue to retain a new lawyer to examine the facts, you are simply likely to get chalked up another disgruntled criminal defendant, as as such typically get very little credibility with such complaints. ...
