Likely, they will require a ruling by the court as to which parent is the residential parent for school purposes. Then you go to a lawyer, who will ask the court to adopt the administrative ruling by the Department of Job and Family Services that the man they have identified as "dad" is dad for the purposes of the court, will prepare a parenting plan for the two of you and will get it all before the court in time for school next fall. If your only "offense" is seeing another woman, it would be very unlikely either of you would end up in Ohio with sole custody. Be aware that nobody is getting sole possession of the child unless there is an action before Ohio Department of Job and Family Services, an action in divorce or an action in legal separation (as opposed to separation on your own terms) is filed before the court. The form would be valid, but?I don't know whether you actually have guardianship, I assume, of your grandchild. I can't speak to Indiana law, so I am not sure exactly what you actually have. If the child is here in Ohio, I would suggest that your daughter execute either a grandparents power of attorney, or that you actually apply for a formal guardianship through the courts here.
