Greetings, please do remember that child support is something to help the other parent out while they help raise and provide for the child. If the custody arrangement has differed, whereas like you say the child is residing with the other parent than it would be nice to forego the child support payments to maintain an effective co-parenting relationship. If you can afford to do so than do help out by paying support while the child resides with the other parent so you won't be percieved as taking advantage. From what you say, your support order is only through the state's office of recovery services, and not through the courts where you have a court ordered support. That makes life very difficult, and ORS does not often actively pursue cases.
If you open a case on Colorado, they will simply move over to Utah's case. It may not be helpful.

If both of you adopted a child and you were never married, then you would file a paternity action in court. You would include the information about the adoption in the Petition. The court would take judicial notice of the adoption. The court would then decide issues regarding the child including child support, parenting time, custody, cost of extracurricular activities, how the tax exemption would be divided, payment of uninsured medical expenses, schooling, etc. It is also possible to reach an agreement regarding these issues, but I would be very careful to have that agreement in writing and submitted to the court so that no one could change their mind. It is also important if you want the court to enforce the agreement.
You may want to calculate what your child support would be. I suggest that you go to http://www.in.gov/judiciary/2625.htm and you can calculate what your child support would be. I do not know how old your child is, but another issue to consider is the cost of college. Please understand that you will not be able to get child support prior to the time that you filed your Petition. A court may not make the child support retroactive to before the time that you file your Petition.
In calculating the child support, only use the income of you and the child's father, do not include other family members.

If you have not already asked CSRU to re-calculate your support payments, you should do that. There is a cap of 50% of your pay, and they should take account of other children you are supporting. If CSRU does not help, you may need to hire an attorney to review your situation and see if the support amount can be reduced. Most attorney wlll consult for miniimal/no charge for your first visit.
You may also try Legal Aid, Volunteer Lawyers Project, or Community Lawyers of Iowa for assistance.

Under federal law, the custodial parent claims the child tax dependency exemption, unless waived by the custodial parent or as ordered by the court. In addition, the custodial parent must sign IRS waiver form 8332 in the year where the non custodial parent claims the child. Whether arrears are owed or not, is irrelevant to the question of entitlement to claim the exemption, unless there is something spelled out in your court papers that the non custodial parent can’t claim the exemption, where it is allocated to them, if there are any arrears of was record . If your ex served you with a contempt motion and you have claimed the exemption improperly, they may order you to amend your return without claiming the child, which would remedy the situation with her filing an amended return as well claiming the child or the court could order you to pay whatever tax loss she can prove by the difference of claiming the child as opposed to not claiming the child. Effective 1/1/18, for your information, under the new tax reform act, all personal exemptions have been eliminated, including the child tax dependency exemption.
