What you need to do is file for Child Support Modification and I believe you can do so from Florida, without going into her state. You will need to know her new address and contact info as well. You can reduce your support and also if the court has you for visitation and she does not allow you to interact with the child than you can also file for contempt. Can a noncustodial parent who receives SSI but also owns their own business still be taken up for child support?

If I understood correctly, the noncustodial parent has his own business and receives SSI but every time you approach child support agencies they close the case? Why are you going through the child support services? Do you have a child support ordered by the court? If its ordered by the court and he is not paying and or you feel he is not paying much because of his business and side income he is not disclosing that you can file for support modification, and subpoena for his financial records. Hello, Thank you for asking questions. Is your ex on the child birth certificate? You will have to file for child support in the county where the children live at. You don't need to know how much he is making, of course having knowledge about it will be beneficial. Usually, when one parent requests child support, both parents have to disclose the financial data. However, if and when he discloses his financial standing and you have concerns about him hiding any form of income, you can use that against him and subpoena his employer for testifying. You should consider using a lawyer though as litigation can become very complex after the initial part of starting it. While you are doing the child support, you should also ask for custody of the children so that it becomes documented and no longer an out-of-court agreement. However, if you guys can agree to your own terms and conditions and cooperatively agree to waive child support, in part of your parenting agreement, the person making less money, and or both of you can explicitly write the waiver of child support as the child needs are currently being met. Okay, to me it sounds like your attorney wanted the case to be over which is why the situation happens the way it happened. Normally there are 30 days to appeal the decision. But you will need to review the court order to see it. However, There may be a possibility to modify the support order because the decision was not yours and it was your lawyer that made the decision. I would personally sue the lawyer as well if he does not overturn the decision. But that is my personal opinion about the lawyer you had. I mean come on, if you don't want to work on the case, just say I don;t want to work on the case and not going to refund the balance of unused funds. But instead, many attorneys use this method to get the case done with. Anyhow, feel free to contact my office if you would like to work with us. How much support are you currently paying and how much would you like to reduce it to. 3. Many times the attorney can represent you in court as long as the judge is okay with your absent, if the judge requires to see you then you will have to appear. Service is the process and proof that you have been notified of a hearing. So, a simple waiver of service, means you accept the notification and no deputy sheriff or process server will serve you. It does not affect your later rights at the hearing. However, carefully review the acceptance of service form. Without knowing the full details of the case we cannot properly advise you of your situation. It is likely that Child Support office has failed to contact/locate the child father and asking you to waive child support and finish the case. It can mean many things, it would be best for you to obtain the copy of the order and have an attorney review it.
