Is it illegal to tell a story online and not tell people it's fiction?

Answered 6 years and 10 months ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Criminal Defense
That sounds like a very interesting idea.  Depending on what your story is about you might be ok.  There are limitations even on your freedom of speech. You should review what those limitations are (ie. hate speech, etc.)  If you intend to cause some type of distrubance you may not be protected.  For instance you cannot run into a theatre and scream "Fire." Be careful. You would be well advised to also send it in to the Library of Congress to record.... Read More

Will I be served with 1 or 2 violation of probation warrants?

Answered 7 years and 2 months ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Criminal Defense
At the time of sentencing for the two previous crimes, you were to have no further criminal violations. When you did, you violated both of the two sentence terms. Probation will likely file two violations against you. You will have to go back before the same Judge for this violation to be heard, and if you are found to have violated,  the penalty to be handed down. It would be in your best interest to hire counsel to address this immediately with probation in an attempt to resolve it prior to the report being filed, and then also represent him in Court with the Judge. This is crucial, and time is of the essence. We handle these matters regularly and would be happy to speak with you further. feel free to contact us at 203-870-6700... Read More

Generally, a criminal charge is nolled when the prosecutor determines that an adjudication of the charges is not in the public's interest, or that the available and admissible evidence is not sufficient to satisfy a jury of the defendant's guilt beyond a reasonable doubt. State law requires that a criminal charge be erased if it has been nolled in the Superior Court, and at least 13 months have elapsed since the nolle occurred. The erased records include all police and court records and records of the prosecuting attorney pertaining to such charge (CGS § 54-142a(c)).... Read More

Probation is considered a privelage, and not a right. It's called "conditional release" for a reason, and one of the easiest conditions to violate is the requirement to regularly report to your probation officer. Your probation officer (PO) may allow you to get away the first time this happens; POs have broad discretion when monitoring their probationers. Parolees who fail to report to their parole officers may be in for similar consequences, although there may be less wiggle room. Although there are ways to appeal these sanctions -- the most severe of which is a return to prison -- your parole officer may only be able to make a recommendation against sanctions. Depending on the frequency or severity of your failure to report, you may be looking at an extended period of parole or even a return to prison custody. If you would like assistance with this matter or further information, please feel free to contact us. ... Read More

Can a 16 and 20 year old have legal sex in CT

Answered 8 years and 4 months ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Criminal Defense
The Connecticut Age of Consent is 16 years old. In the United States, the age of consent is the minimum age at which an individual is considered legally old enough to consent to participation in sexual activity. Individuals aged 15 or younger in Connecticut are not legally able to consent to sexual activity, and such activity may result in prosecution for statutory rape.  You should read the statute below also.  Finally, regardless of what the law says, don't you feel creepy that you have to even ask this question? What can a 20 year old have in common with a sophmore in high school.  Despite the law, a 16 year old is a CHILD.  Think about the impact you will have on those lives.  Give it some good thought. Its a bad bad idea. Connecticut § 53a-70 (a)(2) § 53a-71 (a)(1) First-degree sexual assault to have sexual intercourse with a person under age 13 if the actor is more than two years older Second-degree sexual assault to have sexual intercourse with a person between ages 13 and 16 if the actor is more than two years older 10 to 25 years in prison with a mandatory minimum of five years if the victim is between age 10 and 16 and 10 years if the victim is under age 10. The combined sentence and special parole must equal at least 10 years Up to 20 years in prison (nine months mandatory minimum) ... Read More
