absolutely.  No employer can use any protected classification as a factor in the hiring decision, to reject or offer you the job.  Simple example, an employer calls in Mr. Smith for an interview.  Sees that he's elderly and then decides to not offer him the job because of his age.  Somone gets a resume and tosses it in the garbage because you are a woman and they refuse to consider women for the role.  If the woman was equally if not better qualified and her resume is not considered based upon gender:  unlawful generally.  But of course all depends on the facts and proving this based upon suspicion is a shot in the dark without more evidence and facts as to support your belief.  ...  If it's a work related injury this could be Worker's Comp. retaliation and your employer would be obligated to honor any work restrictions as best it can. For the more you may have protection under the Americans With Disabilities Act as well as the Florida Civil Rights Act if there are possibility and wats to accommodate work restrictions that you have.  Your question is not clear but if you are saying that you filed an EEOC charge for discrimination and they have continued to harass discriminate and will retaliate against you this may be an additional violation of your civil rights. At this point you can file an additional charge for the retaliation but consult a lawyer immediately.    But you may also need to report the additional harassment or retaliation to human resources first... You cannot be fired for demanding that you be paid fairly, and you cannot be paid less than minimum wage for your work. Although normally you would be considered an "employee at will" who could be fired for any non-discriminatory reason, once you complained about not being paid fairly and were fired for it, you became a "whistle blower" because you essentially reported a violation of the law to your employer- being underpaid. You then were protected by the law from retaliatory termination. Assuming you really did not get paid minimum wage and were fired for complaining about it, you have a good case, and the law says your boss must pay your attorney fees if you win. ... Read More
