It depends on the reason you are not getting hired. You would have to prove they are not promoting you for a discriminatory or unlawful reason. Some bases for unlawful discrimination include age, disability, gender, pregnancy, race, color, national origin, religion, military status, and others. Discrimination or harassment is unlawful only if it is based on one of the seven "protected classes."  The protected classes are: race, color, sex, national origin, religion, disability or age 40 or older.  If you are subjected to the treatment you reference due to one of these protected classes, then you may have a claim for unlawful discrimination or unlawful harassment if the employer has at least 15 employees.  However, if the treatment is based on some other reason, then it is unlikely that you can file any type of legal claim. ...
