You can't. By definition a sociopath wont care about the consequences of thier actions. You can try various options including litigation, but this is often expensive and may not get you a result beyond a money judgement if you can collect it.If you have further questions, feel free to contact our offce at 1-800-922-6442 for a FREE consultation. ... First, what you describe is a business defamation type case. Typically, such cases are not handled by competent lawyers on a contingent fee basis unless (a) the legal liability is crystal clear (2) there are $100,000.00 in clear indisputable damages and (3) there is clear ability to collect those damages upon rendering of a judgment. Unfortunately, this applies to very very few cases, though 99% of litigants will rush to explain how they are all in that 1%. Typically, you wil have to retain a lawyer to gather the facts, determine how to proceed and likely initiate the legal action you describe as appropriate. Be prepared however, to spend a signficiant amount of money in the early phases of such a case as there is usually a good deal of leg work and legal research expended to be handled properly. If you have any further questions, we do offer FREE consultations. Just call our office at 1-800-922-6442.... Read More

I am sure there are a number of lawyers willing to help you with this. The key is whether it would be done on a contingent fee (where lawyer gets paid a percentage if he handles the case and "wins") or pre-paid hourly rate. If you are looking for a "second opinion" most lawyers that will do so would bill at an houly rate for this, as very ver very few will provide "free" consultations for the purpose of reassuring a litigant that the lawyer actually getting paid to handle the case is doing a good job. How do I stop online (facebook) defamation of my name?

Answered 11 years and 9 months ago by attorney Karen A. Leiser   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
The difficult thing about defamation law is that the First Amendment right to freedom of speech is very strong and it is almost impossible to get a gag order on someone.  What you can seek in these types of claims is monetary compensation for the damage incurred due to the false statements.  Ordinarily, getting slapped with a large judgment against them is going to shut most people up from making the same types of statements again.  If it does not, then you sue them again.  And again.  And you keep collecting monetary judgements against them to compensate you the injury to your reputation. Another hard part is showing the damage that was done and determining how much that is worth.  Certain types of defamation, such as those that are directly related to your ability to do your job, or that impugn a woman's sexual purity, or that falsely accuse you of a crime of moral turpitude, that is lying, cheating or stealing, are considering "defamation per se" and you don't have to show any actual damages.  It is assumed that such statements have harmed you and you can obtain a monetary judgment.  It does not answer the question of how much money you would be awarded - that would be up to the judge or jury.  The is also never any guarantee that you can collect on any judgment you receive. This answer is given in accordance with the laws of Virginia and may not be applicable in any other state.  It should not be construed as legal advice, as that would require a more thorough analysis of all of the facts involved in a specific case.  If you need further information or assistance, please feel free to contact my office for a consultation. Case results depend upon a variety of factors unique to each case. Case results do not guarantee or predict a similar result in any future case.... Read More

Do I have a case for defamation?

Answered 11 years and 10 months ago by W Chase Carpenter (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
Defamation, in its most basic form, generally requires the following elements: 1. The Defendant published a false statement; 2. About the Plaintiff; 3. To a third party; and 4. The falsity of the statement caused injury to the plaintiff. Most common issues with completing the necessary elements for defamation are either that the statement made by the potential Defendant was an option and not a statement of facts or that there was no injury to the potential Plaintiff.  In the situation you described, what I commonly see is that the statement made on Facebook, while perhaps untrue and downright mean, is an opinion.  Without seeing the posts or knowing more about you, I obviously can’t give an opinion on whether the statement is an opinion.  Another consideration is that even if you have a case, litigation is expensive.  Now, from a practical consideration, your first step should probably be to contact Facebook and make a complaint.  I believe they have a link from the homepage.  You mention that these statements are being made on other venues as well.  You may find spending some money to hire a lawyer for a cease and desist letter.  Oftentimes, these are enough to stop the conduct.... Please note that in Pennsylvania, any action on defamation has a one-year statute of limitations.   This response is provided as general legal information only and does not form an attorney-client relationship.... you have the option of utilizing an 'order to show cause' which is a court order that this behavior must stop. you set forth her behavior and demonstrate that this is tortious interference with your business. you must be extremely specific and demonstrate how your business has been hurt.  this would be the first step-stop her from hurting your business. the next step is setting forth how you were damaged and the amount of business lost. this is more difficult unless you have specific examples. valter must, esq. is a certified trial attorney. he is my partner. he would represent you in court. the legal fees would be $5000. we are ready to proceed. ed dimon, esq. 732-797-1600... It depends if it is an opnion or a statement of fact. If it is a statement of fact that is false you likely would have a defamation claim. If it is something that you think will negatively impact your business I would suggest that you have an attorney write a letter demanding that the comment be removed. Thanks, Jon... Read More
