Could they come after me if my estranged husband is being sued for a car accident that happen before we were married?

Answered 12 years and 5 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
No. Not unless your future husband was an agent of yours during that car trip that caused the July 2011 car accident. It seems to me that would be difficult to prove, so you appear to be safe from actual liability. Of course, safety from actual liability does not guarantee you won't get sued. If you ever get sued wrongfully, consult with a lawyer immediately.... Read More

How much should I settle for concussion and neck injury at school after a student attacked me?

Answered 12 years and 5 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
The settlement evaluation of workers' compensation claims depends on several factors. Among other things that may be important: Are you still out of work, or have you returned to work for your pre-injury Employer, or a different Employer? Are you still having physical problems with your injuries? Are you still seeking medical treatment? Do you have any permanent injury? I would be glad to speak to you by phone (free consultation) to learn more about case and give you good legal advice. Of course, by having a free consultation, there is no obligation for you to use me as your lawyer.... Read More

Frature leg and damaged car because of the neglect of the city of Duluth, GA

Answered 12 years and 6 months ago by attorney Aaron P. Marks   |   1 Answer   |  Legal Topics: Personal Injury
I am sorry to hear about the accident. Based on the facts that you have given me, you may have a claim against the property owner for premises liability. Property owners, including the city of Duluth, are required to maintain their property in a way that keeps others safe. If a person is using the property in a normal way, and is injured because of the unsafe condition, the property owner may be responsible for the accident. In you case, the city may be responsible for compensating you for (1) medical bills, (2) lost wages for missed work, (3) pain and suffering, (4) the damage to your car, (5) any permanent impairment, and (6) inconvenience and loss of enjoyment of life. If the city knew that the property was not safe and failed to repair it, you may even be able to collect punitive damages, which are intended to punish wrongdoers who act in a particularly heinous way that endangers others. You should consult with a personal injury attorney who has experience handling premise liability cases. An initial consultation with any good personal injury attorney will be free, and an attorney will be able to tell you what steps to take next. I have successfully handled some similar cases, and I would be happy to talk to you about the accident. While it can seem bewildering, an experienced attorney will know exactly what to do so that you can get all the help that you need. In the meantime, make sure to follow up with the doctor as necessary, for two reasons. First, and most importantly, follow up visits will ensure that your leg heals properly. Second, people (claims adjusters, attorneys, and even jurors) are often suspicious of those who claim to be injured but fail to follow their doctor’s treatment plan. If you need assistance obtaining medical treatment, I may be able to help. I have relationships with several local doctors and have been able to arrange for my clients to obtain medical treatment at no cost to them, with the understanding that the client will reimburse the treatment providers once the case settles or we win at trial. Finally, please do not speak to anyone in person or over the phone, except police, about the accident without an attorney present. Insurance adjusters and are trained to minimize the damages an injured party can recover and may try to get you to admit fault in the accident. I wish you the best of luck and feel free to contact me with any other questions you might have. ... Read More

Every case is different and there are many variables that can come into play in deciding whether or not to hire an attorney. However, you should at least talk to an experienced personal injury lawyer before making a final decision about how to handle the matter. An initial consultation is free, and an attorney will be able to tell you what steps to take next, with regard to the police, your insurance company, and the other driverยฟs insurance company (if any).ย  While it can seem overwhelming, an experienced attorney will know exactly what to do so that you can get all the help that you need. First, let me say that I am very sorry to hear about the accident. I know how scary an automobile accident can be, especially when your child is involved. Whenever a person is injured or harmed as a result of someone elseยฟs negligence ยฟ such as in a car accident ยฟ the injured person may be entitled to compensation for (1) medical bills, (2) lost wages if the person is unable to work, (3) pain and suffering, (4) any permanent injury or disfigurement, and (5) inconvenience and loss of enjoyment of life. Although you donยฟt provide any specifics, if the other driver was acting in a particularly heinous way, your son could also be entitled to ยฟpunitiveยฟ damages, which are intended to punish a person for acting in a way that endangers others. You do not mention whether your son sustained any injuries, but obviously your biggest priority is getting him whatever medical attention he needs. If he does not have health insurance or the means to pay for medical care, a personal injury attorney may be able to help him see a local doctor. For example, I have relationships with several local doctors and have been able to arrange for my clients to obtain medical treatment at no cost to them, with the understanding that the client will reimburse the treatment providers once the case settles or we win at trial. I have successfully handled many car accident cases and I would happy to talk to you and answer any questions you might have. In the meantime, you and your son should not speak to anyone (in person or over the phone) about the accident, except police, without an attorney present. Insurance adjusters are trained to minimize the damages an injured party can recover and may try to get you or your son to admit fault in the accident. Good luck. Who charged you with battery? The girl? If so, you are in trouble because you actually did touch her without her permission. If it was a third party (teacher), the case will depend on what the girl says under oath. I think that you need a lawyer. If all of the facts come out, and they are exactly as you have told me, the judge would possibly throw the case out.... Read More
