can I sue my landlord

Answered 11 years and 5 months ago by attorney Mr. Evan Austin Watson   |   1 Answer   |  Legal Topics: Personal Injury
There is potential liability on your landlord in a situation like this.  However, more facts would need to be known to truly assess if a lawyer would be able to help you out.  While landlords do have some duty/responsibility to keep a premiss safe, they don't have an absolute obligation. ... Should I meet with an insurance agent in person at a public location to discuss my settlement claim?

Answered 11 years and 5 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
If you have an injury claim, the best policy is to speak to a lawyer before speaking to an insurance representative. Remember, everything you say may be used in an attempt to deny or minimize your claim.

If I was the driver of a car and suffered a concussion, what is the value of claim when victim has no visible injuries?

Answered 11 years and 5 months ago by Mr. Aman Ravin Patel (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Personal Injury
The value of the claim depends on numerous factors. One, what are your current medical bills? That is an item of damage recoverable under Georgia law. Two, what are you injuries? You would need to get a copy of your records to determine what the doctors have diagnosed you with. Three, are your injuries permanent? Yet again, you would need to take a look at your medical records. How long was your recovery? This is an item of your pain and suffering, which is recoverable under Georgia law. Four, do you need future medical care? Yet again a doctor record will let you know that. As you can see, there is a lot of components to look at to determine the value of your claim. I would recommend that if you were concussed, that you talk to an attorney, especially if you were taken to the hospital by ambulance.... Read More

What can I do if my former doctor lost his license?

Answered 11 years and 5 months ago by Edwin K. Niles (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Personal Injury
If you can track them down, you can get copies of the records. However, I doubt that the doc, under these circumstances, will want to bother doing a narrative report.

Should i hire a lawyer from another city?

Answered 11 years and 7 months ago by attorney Mr. Lee P. Morgan   |   1 Answer   |  Legal Topics: Personal Injury
Unless you have signed a fee agreement, you are under no obligation to hire an attorney simply because he or she gave you advice.  If you are being hounded by an attorney to hire a particular firm, this is a red flag that the firm is more interested in taking in as many cases as possible than in giving good service to its clients.  Talk to other attorneys in your area.  Retain an attorney that is experienced, compassionate, and carefully answers your questions.  You'll be much happier in the end.  MORGAN & MORGAN ATTORNEYS AT LAW, P.C. I am very sorry to hear about your burn as I'm sure that is very painful. There are many factors that would need to be determined first in order to know how to proceed with your claim. Did you notice a video camera at the store? Video footage would be helpful in determining if the manager and employee were negligent in the manner they were stacking the bleach. Are you still suffering from pain in your ear? If you have health insurance, I strongly recommend that you continue getting your necessary medical treatment. If you do not have health insurance, an attorney may be able to help you see a physician. I have relationships with physicians all over the state of Georgia and can arrange treatment at no cost to you. You would only need to pay for treatment when your case settles. As this case has many unknown factors, I highly recommend calling an experienced personal injury attorney. Personally, I have handled many cases very similar to yours. I meet with all of my clients for free and only charge the client when their case settles. In the interim, I recommend that you do not speak to the retail store or any insurance representative calling on behalf of Freds. Anything you say to them can be misconstrued and used against you to devalue your claim. An experienced attorney will be able to tell you how to proceed to protect your rights. Please call me directly at (404) 620-2846 if you have any questions. Good luck and I hope you feel better soon!... Do I have a valid claim for a suit?

Answered 11 years and 8 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
The facts do justify a consultation with a medical malpractice specialist, to determine whether or not you have a claim which can be pursued against the pharmacy. I do not think this is the type of case you would want to handle on your own, as malpractice law has many technicalities that can easily defeat your case. Many lawyers, including myself, offer free phone consultations. An initial phone consultation is useful for a lawyer to gain additional facts to evaluate your case. A consultation will often allow a lawyer to gain sufficient information to give meaningful initial legal advice.... Read More

Can I sue a ER Dept. or Dr. for not treating my symptoms and also not recognizing mental illness?

Answered 11 years and 8 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
I regret to inform you that I do not believe you have a cause of action regarding this incident. It is unfortunate that you were not treated better, as your emotional difficulty may have intensified. However, I do not believe Georgia law would support a lawsuit given these facts.

What will happen if they have insurance but both occupants have suspended license?

Insurer should be made to provide coverage in that situation. You may need a lawyer to enforce it, though.

Answered 11 years and 8 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Even if you won, you would expect difficulty collecting. Unless the customer had assets, I don't think any attorney would be willing to handle this type of case without a retainer of several thousand dollars.

Can people who sent multiple messages on the internet telling her kill herself be charged with manslaughter?

Answered 11 years and 9 months ago by Mr. Mark Preston Jones (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
This is a very unlikely claim. Generally suicide will be an intervening cause preventing liability of a third party in most cases. Hope that helps. You may want to contact the District Attorney where the text messages were sent and/or received to alert them to this issue though.

This is not a legal question, but a "Dear Abby" question. I would recommend that you move away from your parents, if it is financially feasible and you are a competent, responsible adult.

Did the other driver get a ticket? If so, the other driver's insurance company should at the least pay for damage to the vehicle. I think it's worth making an insurance claim for bodily injuries (through a lawyer) in this situation. However, because of your illegally driving the vehicle, it looks like a difficult case to take to court (unless you have severe injuries).... Read More

If I was assaulted in hotel lounge, who would help pay my medical bills and lost wages?

Answered 11 years and 10 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
The hotel may have insurance coverage called "med-pay" that may pay some or all of your medical expenses. Ask the hotel to put you in touch with their insurance carrier and ask if the hotel has "med-pay" coverage & if they do, how much. Tell the insurer you would like to make a "med-pay" claim, if this coverage is available. Otherwise, your complaint is against the person who assaulted you, & even if you won in court, it would difficult to collect unless he is wealthy.... Read More
