Do I have any recourse after a collision with an uninsured driver? How?

Answered 10 years and 7 months ago by Edwin K. Niles (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Personal Injury
First, check your policy to see if you have uninsured motorist (UM) coverage. If not, do an asset check on the other driver/owner, to see if there's a chance of getting anything. Finally, you may be able to recover something from the Victims of Crime Fund.

If there is an accident, are we responsible for any damages and could we be sued if they don't get insurance?

Answered 10 years and 9 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
If the insurance was not cancelled, it would appear to be your insurance that continues in effect & covers damages. As to whether you are responsible for damages in excess of your auto insurance coverage, more information would be needed. At this point you should work with your auto insurance carrier, & they should be able to answer your questions.... Read More

How do I get my chiropractic bills if my chiropractor won't give them to me?

Answered 10 years and 9 months ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You do have a legal right to your medical records and bills. However, the question is how do you enforce this right. It is a sticky situation, but I think the decision on how to proceed can be best made by the personal injury attorney handling this accident case for you. If you are extremely dissatisfied with your attorney's handling of the matter, you legally are not required to continue using him/her as your representative.... Read More

Just tell your auto insurer all the details, and rest assured that they are experienced in handling this type situation. Unless you are injured, there is no need to file a claim, after the property damage is taken care of.

How does one get damages from a carrier if there is incorrect information?

Answered 10 years and 11 months ago by Robert Andrew Michael Burns (Unclaimed Profile)   |   14 Answers   |  Legal Topics: Personal Injury
You should work from the information you do have. You shared none of this. You should file an SR-1 form with D.M.V. which might help. If there was a police officer at the scene some type of report or note should have the information, though the motorist may have lied to everyone. Hopefully you were smart enough to get the license plate and driver's license and name of the motorist. If not insured, you should push for prosecution in which you'd seek restitution for your economic losses.... Read More

Pursue a claim through the prosecutor for restitution for economic losses and decide on whether your damages are enough to pursue competently (something you obviously aren't doing) so as to justify paying a lawyer.

How do I handle a he-said-she-said accident case?

Answered 11 years ago by Mr. David B. Rechtman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You can sue the other driver in small claims court. Most larger counties in Georgia have Magistrate Court for this purpose. The largest amount you can claim in Magistrate Court is $15,000. Of course, the dispute before the judge will come down to he-said-she said. The goal is for the Judge to evaluate your story as more believable, given the circumstances. Unfortunately, attorneys do not generally get involved in these cases, especially on contingency liens. I hope this was helpful, and good luck.... Read More

Based on the information you provided, my answer is ABSOLUTELY NOT!  It is the responsibility of an attorney to hold any settlement proceeds in trust for the benefit of his/her client until the funds are properly disbursed.  An attorney cannot use trust funds for any other purpose.  There may be facts in your case that you did not make clear, but based on the information you supplied, it would be in your best interest to consult with another attorney right away.  In the alternative, you may want to consider contacting the State Bar of Georgia to discuss filing a complaint.  MORGAN & MORGAN ATTORNEYS AT LAW, P.C. Motorcycle wreck sent to a level one tramua .

Answered 11 years and 2 months ago by Mr. John Michael Phillips (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Personal Injury
You seem to have a case for damages.  Give us a call. Some lawyers build cases from the bottom up- meaning they start with the amount of bills and expenses. Or start from the top down- focusing on those intangible losses you have suffered such as loss of enjoyment of life, mental anguish and pain. No calculator will add those up. We've seen people who have given up active play with their children, gardening, motorcycles and many other things that make a hard life good or a good life great. And, worse yet, have mounting bills hinder their credit.  Lawyers can help. Insurance carriers try to negotiate every dollar they can, because every $100 means millions in the end to the Board of Directors. Even in soft tissue injuries, those tissues stretch and scar, or cause corresponding pressure on nerves in the spinal cord, leaving behind permanent problems for some. I have had clients need surgeries years later because of a bulging disk and have their entire world collapse for what seemed inconsequential at the time. Insurance companies want you to settle as soon as possible and treat as little as possible. Attorneys matter. Carriers change their gameplan when a lawyer is involved. It seems like your injuries are more serious. For that reason - and the misinformation by TV lawyers and referral services- is why people should consult lawyers who take the time like on sites like this. Because of the economy, more lawyers are jumping into personal injury and should stick to what they know. Personal injury law REQUIRES knowledge about medical science and biomechanics (the forces on a body in a wreck) far greater and more specific than you'd think. The other side has doctors and millions on their side to say nothing is wrong or fight the claim. The more a law firm advertises, the less likely it is to give personal attention. If you order a cheeseburger, you don't often meet the chef. If you buy a shirt, you virtually never meet the designer. But hiring a lawyer is different. A lawyer is your spokesperson. Unlike a burger or a shirt, it can be a relationship which will last a lifetime. Give us a call to discuss this confidentially and for free.  John Phillips, 904-444-4444, jmp@floridajustice.com. ...
