How frustrating for you and your wife! In our office, the difficulty in getting benefits and help at home is usually due to the medical opinions in the case (or lack of supporting medical opinions). Have the doctors stated that your wife is unable to work? Have the doctors recommended home care to assist her? If so, then the attorney should be able to make a demand for lost wages and get some assistance for her. If such benefits were not awarded two years ago, I assume the doctors gave an opinion that she could work or some time limit ran on those benefits. Getting the MRI approved may require another motion. I recommend that you and your wife schedule an appointment at her attorney's office. You have asked this question before. although granted this time the wording is a bit better than last time (see below), the answer isn't going to change. My husband and I let a friend borrow our car a couple months ago he filled the tire down the ladder on top of the van resulting in the latter falling off and hitting another car he then ran from the scene and left the van in the parking lot nearby he later called us and told us that he left the van in a parking lot but did not tell us that he the ladder fall off and hit another car we didn't get a letter in the mail letter stating that Ivan and I is at fault for the latter hitting another car we are now being sued shouldn't our friend be the one at fault what should we do about this I really can't tell exactly what's going on because you don't use the proper words consistently - for example is it a car or a van - there is a difference also what the heck does "filled the tire down the ladder on top" even mean? If you were injured as a result of an intentional assault, you have a civil claim against person responsible. A landowner is generally not  responsible or intentional torts committed on the property by mere virtue of the assault having occurred there. Whether or not medical malpractice occurred during the delivery can only be determined by carefully reviewing the medical records including the fetal heart monitor strip. From your description it sounds like the baby suffered from asphyxia during the delivery. Again, the length of time and duration of and extent of fetal distress can be determined from the birth records. As I understand from your question, foreign material was left in your abdomen following your 1997 surgery. This was discovered in 2012. Based on these facts, I am afraid your statute of limitations for filing a lawsuit has expired. It appears to be too late, given the facts you set forth in your question. If you signed a "Release" or "Release of Claims" with an insurance company in order to get your medical bills paid, then that Release is binding and final. However, if you did not sign a Release but only got your medical bills paid up to the Utah minimum of $3,000.00 PIP (Personal Injury Protection) then you may have an injury case. In Michigan your insurer pays to repair/replace your vehicle. If there are uncovered property damages, you can make a mini-tort claim against the truck's insurer (this only provides limited coverage). If you have a serious impairment of a body function and/or permanent serious disfigurement (or death) you can make a personal injury claim against the bakery which it's vehicle insurer should defend/pay. If you have wage loss, medical treatment expenses or the need for household help, you have your insurer pay these (by properly and timely filling out their forms, providing proof of loss). You seem to be handling this matter on your own. If your case is small and expectation is small from the case you can cooperate with the insurance company although they will take advantage of you . If you want to be smart about it, hire a lawyer to deal with this since insurance company will not give you the fair value of your under any circumstance of you deal with them directly.
