All businesses in Washington that hire employees must have Workman's Comp coverage (either the State sponsored plan or a self insured plan). If they don't have the coverage, you can sue them just like you could sue anyone else, and you don't have to prove negligence, i.e., they are treated the same as if they had the coverage, and they are liable for all of your damages.... Court of Jurisdiction

Answered 11 years and 10 months ago by Charles James Brocato (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Jurisdiction in this case would be where the accident occurred, CA. You should speak to an attorney near where the accident happened or where the defendant resides. Be careful, as the statute of limitation in CA is only 2 years from the date of the accident. This response is general in nature and is not legal advice. No attorney client relationship is formed by it. Further, the response does not represent the opinions or views of LexisNexis or its affiliated companies.  ... Read More

Since this was a work related incident, you will be covered by Workman's Comp Insurance for your medical bills, your wage losses, and disability through that system. Also a possible claim under the Crime Victims Compensation act. Then there is a possible claim against the parents, but since they were not there in a supervisory capacity, that claim may not be worth pursuing.... Read More

What legal options do I have to get my product back and will he have to reimburse me for the damages he did to my product?

Answered 11 years and 10 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury

I guess you need to go to the store and demand the return of the product. Have an expert look at it and find out what damage was done to it by the mechanic, and find out if it was actually repairable before the mechanic did additional damage.. If it could not be fixed, then the damage that was done did not matter.... Read More
