do major hotels have to provide safety strips or mats in tub to preveny a fall

Answered 11 years and 6 months ago by Charles James Brocato (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Any hotel has an obligation to make their bathroom reasonably safe for the public. If the tub was unreasonably dangerous they would be liable. This response is general in nature and is not legal advice. No attorney client relationship is formed by it. Further, the response does not represent the opinions or views of LexisNexis or its affiliated companies.  ... Read More

If you did not go to the hospital to document the extent of your injuries, you do not have much of a claim.

In order to even have a claim you would have to show the stair were defective or unreasonably dangerous in some way. You would also have to show whoever owns  or operates the facility knew or should have know of this danger.

How do we defend ourselves when it is our word against her that our vehicle has not been in any collision?

Answered 11 years and 6 months ago by Thomas Edward Gates (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
First, you retain an attorney. Your insurance company may pay for one to defend you, since her insurance could ask for repayment. If indeed you struck her, there would have been visible damage to your car. Take it to a body shop to inspect and then have them sign an affidavit attesting to the fact there was no damage, nor had any work been done on the car.... Read More

Can I sue my dentist for her bad dental work on me?

Answered 11 years and 6 months ago by Georges Herman Shers (Unclaimed Profile)   |   11 Answers   |  Legal Topics: Personal Injury
The lab might be the one at fault for losing your dentures. Cash the check if you did not agree to it as a settlement for your potential claim. Find out how much it would cost for new dentures, add on some unknown amount for not having teeth for the period of time, travel expenses, time missed from work, etc., and make a demand to her and the lab for that amount. If they will not pay to your satisfaction, you will have to sue in Small Claims Court.... Read More

Lawyer not returning phone calls on a settlement what should i do?

Answered 11 years and 7 months ago by Charles James Brocato (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Settlement funds have to be placed in an attorney's trust account so, hopefully, you will not have to worry about the safety of the settlement funds. I would call again and if you can't get hold of the attorney, leave a message telling her you will be contacting the WA State BAR association about the problem if she doesn't get back to you immediately. I'm sure she wouldn't "close" the case without talking to you.... Read More

What form do I need to file for a personal injury from an auto accident and can I get the filing fees waived if I am poor but not indigenous?

Answered 11 years and 8 months ago by Thomas Edward Gates (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
If you are not indigent you may not be able to get a filing fee waiver. Contact court clerk and they can tell you if you qualify. Not knowing what stage your matter is at, it is difficult to give your direction. Generally, a attorney would draft a Demand Letter to try to settle the matter. If this fails, the one would file a lawsuit, which requires a Summons and Complaint. It would be in your best interest to seek an attorney who handles personal injury matters.... Read More

Should I get an attorney before I settle my injury and how soon?

Answered 11 years and 8 months ago by Thomas Edward Gates (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
It depends upon the severity of your injury. If you are "back to normal range of motion," then there is nothing requiring an advocate since L&I has a table identify damage awards. However, if your injuries are more severe, than an attorney should be retained.

Your mother is not a party to any lawsuit. Further, your claim is not worth a lot of money and, likely your legal fees will take all that you may receive. Your best option is small claims.
