I fell and broke my hip in a chain store, do you think I can get medical expenses covered

Answered 8 years and 10 months ago by Anthony Van Zwaren (Unclaimed Profile)   |   2 Answers
As Ms. Anderson suggests, if there was fault on the part of the store, they may be liable in whole or in part. Simply lifting a heavy item and having a cart move does not necessarily imply fault on the part of the store, unless there was a defect in the cart. However, if after going over the facts with an attorney there does seem to be a case, then you could file suit and medical expenses could be part of your claim. However, this is not like an automobile accident where medical bills are covered under "no fault" insurance. Unless you can prove fault on the part of the grocery store, it is to be expected that the store would not readily cover medical bills without going to court.... Read More

You will sue the person that owned the house, not the home owner's insurance company directly.  You will sue the home owner for your injuries, and the home owner will then notify their insurance company of the litigation and the insurance company will then get involved.  You will most likely not have to pay the lawyer up front.  If you choose to sue, you will be able to find a lawyer that will file the litigation for your, and the lawyer will be paid from a portion of what you receive in compensation.  That is know as a contingency fee case, because the lawyer's fee is contingent on you getting an award of money from the lawsuit.  PLease fell free to call my office if you want to discuss this further.  ... I broke my leg falling at friends who has a mobile home but it was outside and he rents the land who do I Sue

Answered 10 years and 8 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer
You should contact a personal injury attorney, who will put all possible responsible parties on notice of the claim. Ideally, once that happens the carrier for one of the parties will accept responsibility for the claim. If not, the likelihood is that your attorney will litigate against all parties and liability will be established via motion practice. You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. You can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts. If you are unable to find a lawyer who meets these qualifications within your state, sometimes you may contact an out of state lawyer who can refer you to a qualified attorney in your state while providing support related to the issues of medicine. Click here and here for more information about me. Please note that by attempting to answer your question, I am not acting as your attorney. With a significant injury like that, you really need to contact a workers compensation lawyer who can fight to get your dad the care he needs. Unless the school contracted out the ice removal work, he is probably barred from suing the employer. Click here and here for more information about me. someone slipped and fell on a parking lot I sealcoated

Answered 11 years and 4 months ago by attorney Diana L. Anderson   |   1 Answer
I don't think so based on what you wrote.  If you were not named as a defendant in the case intially, and have not been added, then you are not being sued.  The person who owns the parking lot is being sued, and they might try to bring you into the case, saying that the reason the person slipped was your fault due to something you did wrong with the sealcoating.  But until you get served with a complaint, or an amended complaint with your company's name on in, you are not being sued.  The other attorney might have just copied you on the documents. ... I was injured while working out

Answered 11 years and 10 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer
You may have a viable case. In my experience, belts on workout machines are there to secure you so that the weight does not pull you out of the seat, not for safety reasons. If there are no directions on the machine that indicate that the belt needs to be put on, then you probably have a viable case.  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free.  Click here and here for more information about me. If you wait after a slip and fall accident can you still file a lawsuit?

Answered 11 years and 11 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer
You can still file a lawsuit, so long as you file before the two year statute of limitations. Additionally, if the accident invovled a public entity, you have to file a Notice of Claim with the state within 90 days.  Waiting sometimes makes the case more difficult if the accident was not documented at the facility and you did not seek immediate medical care. That said, if you have suffered siginifcant injuries, a lawyer can probably help you.  You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. The apartment complex had an obligation to keep the area free from ice and that obligation did not start at 9:00 am, it started when the ice formed and posed a hazard. A question will be whether they hired a snow and ice removal service to take care of these kinds of problems or whether they did it with their own maintenance crew.  It sounds like you have a significant orthopedic injury. If you are having radiating pain into the legs, the concern is that you have spinal pathology. When pain like this does not abate, the next step is diagnostic studies, usually in the form of an MRI exam.  You should contact a local attorney who does personal injury law, who will put the apartment complex on notice of the claim and contact their insurance company on your behalf.  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. I fell at my condo complex parking lot can I make them pay for me to see a doctor and can I sue?

Answered 12 years and 2 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer
Whether you can sue depends on the reason for your fall. If it was ice, you can probably make a claim against the owner of the property and the entity that clears the parking lot.  You can use the "Find a Lawyer" service through this website to research personal injury attorneys. The answer to this question is going to depend on the location of the sidewalk and the ownership of the property on which the sidewalk is located.  In many areas, the sidewalk is actually located on your property, and the town in which you live has an easement over that part of your property.  This makes the sidewalk your responsibility to maintain and can make it your responsibility if someone falls on the sidewalk.  You might start with a survey of your property to see the location of the sidewalk, and also talk to the zoning department of the town in which you live.  ...
