the proper answers can be given only with a detailed review of the facts. however, the police are given wide latitude to make arrests or to issue summons. the judge will not care if the officer crossed over into the next town. the 'summons' is merely a legal document to get you to court. the judge will focus upon the defendant's actions. the judge will also not focus upon the number of tickets. charges are amended all the time. in the same manner, typo errors including the wrong date are corrected. i would focus upon the merits of the charges. please call if we can help. ed dimon, esq. 732-797-1600... Because this is a traffic misdemeanor and, as you said, you could face potential jail time, you definitely want to have a lawyer represent you to make sure your rights are protected and that you get the best possible deal. If you just don't show up, you could end up with a Failure to Appear - a separate offense - on your record, as well. Unfortunately, this type of offense cannot simply be prepaid like a speeding ticket, so you will have to attend court. Honestly, as fast as you were going, you can probably count on a few nights in jail, so be prepared for that and just face the music and get it over with. You do not want to be a fugitive from justice.

What the officer is referring to is a petition that the police can submit to the RMV to suspend someone's license as an "immediate threat." You would not have to surrender your physical license -- you would get a letter from the registry notifying you that your license is suspended, and then it would be on you to petition the RMV for reinstatement. There is nothing you can do proactively to prevent him from submitting the petition if he feels that he has sufficient evidence that your driving poses an immediate threat. You should consider ways of generating documented proof that your driving is not as bad as your neighbor says, in case this does escalate.... Read More

I recommend that you go to the magistrate's office in person and plead not guilty. If you appear in person and don't have the funds, you don't have to post a bond.
When the hearing comes, talk to the police officer about your financial situation. Even if you're found guilty, you can ask the judge to put you on a payment plan. Traffic violations don't usually cost less than what you have been fined.... Read More
