The time period within which a lawsuit has to be filed with the court for an auto accident is three years, so it sounds like it was filed in a timely manner.  You need to hire a lawyer to defend your daughter.  If there was no insurance, she personally will be liable for any amounts awarded in the lawsuit. That can follow her for years as they try to collect on it. The other side will have to prove the damage to the car and for any injuries to the person. That is complicated, but possibly could be done.  You can request (normally through a lawyer) all the medical records, medical bills, car repair bills, etc.  If the other person had 'uninsured motorist coverage' then their insurance paid their claim, and the insurance is trying to get reimbursed. This complicates it even more.  I don't know how you would get through this without hiring a lawyer.  It may be the case can be settled for less than it would cost to defend the case. ... Read More

Can I file a lawsuit against after being harassing to take me to jail right away if I donโ€™t sign the citation immediately?

Answered 7 years and 5 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
The only thing that signing the citation does is that you agree to show up at the booking date and/or court. If you had not signed the citation, then you would have been taken to jail. You can not sue because signing was to your advantage.

How many points do you need to lose a probationary license?

Answered 7 years and 5 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
There are multiple issues which must be addressed with both the municipal judge and with NJ DMV. The first issue is the speed. The municipal judge will be inclined to take away your license for some period. This is made more serious by both your age and the number of people in the car. You must also deal with NJ DMV. I would like to explain our approach which mitigates the consequences. Please call asap. Ed Dimon, Esq. 732-797-1600... Read More

Can I get speed reduced to avoid points

Answered 7 years and 7 months ago by attorney Kathy Williams Richardson   |   1 Answer   |  Legal Topics: Traffic Violations
I cannot tell you whether you could get it reduced on your own.  It will depend on how good your legal skills are, among other things.  However, an actual attorney can probably get that reduced for you.  You should contact an experienced traffic attorney who is located near the county in which you got the ticket.  They can also handle the case without you having to take time off of work to come to court yourself.  Good luck. ... Are there any laws regarding notification time of parking tickets?

Answered 7 years and 8 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
There are no time constraints for parking tickets. You can work with the court to make sure all the tickets are proper and correct. You should be able to negotiate a settlement if there are large numbers of tickets in a very short period. Do not ignore these tickets in that there will be an arrest warrant issued. I received 4 citations for one traffic stop, I don't know if this means my license will be suspended. Can you help?

Answered 7 years and 9 months ago by Ryan L Hyde (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
They can cite you for any conduct they witness you committing.  This means if your conduct violated 4 sections of the vehicle code the officer can write four tickets.  You generally can enter into an agreement with the officer (depending on your conduct at the stop and prior history) for lesser citations.  You, however, have only 10 days to enter into a plea.  If a plea of guilt has been entered you only have 30 days to appeal it to the Common Pleas Court.  Your best course of action at this point, given the severity of the charges and punishment, is to sit down with a local traffic attorney who can walk you through how the courts and police departments in your jurisdiction handle these types of cases.  ... What should I do? Should I fight this or pay for it?

Answered 7 years and 9 months ago by Ryan L Hyde (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
In general this is a cost benefit analysis that only you can make.  A stop sign violation carries with it points.  Those can affect your insurance rates and create various other issues.  While it is a minimal violation, there are violations that can be negotiated as outcomes that do not carry points.  The fines often change though.  Remember you only have 10 days from the receipt of the violation to enter your plea.  Many people take the time to talk with a local attorney who can tell you what options are available in the court that you are charged.  ... Is there any way to ask for shorter time for a suspended license due to traffic violations?

Answered 7 years and 10 months ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
I am afraid there is no way to answer this question without seeing your driving record and understanding why your license was suspended (or revoked - they are different things). However, "extensions" of a suspension or revocation often happen if a person gets a traffic ticket while their license is suspended or revoked. If that is the reason it was extended, it is not likely it can be shortened. I would contact a lawyer, talk to them directly, have them get your driving record (or you can do so by going to any DMV office and paying $9), and analyze the situation to see if there is anything that can be done.  You should be prepared to pay for the lawyer's time for doing that. ...
