My work is denying my claim because they said no one seen my back injury happen. Now I was sent home last Saturday and MRI shows a torn disc

Answered 8 years and 6 months ago by Gerald Gregory Lutkenhaus (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
You need to contact an  experienced workers compensation lawyer. In order to have a claim, you need to have had an "accident at work" that caused the back injury ono the 18th. It does not help that no one saw your back injury. If you promptly reported it, then that is a good think. Hopefully, in your report, you specified a specific incident that caused your back injury. You can contact me for further advice about this matter. ... Read More

You need a work comp attorney as soon as possible.  A good work comp attorney will fight for all benefits and treatment, including psychiatric and psychological.  If there is any causal relationship to the fall, there are means to obtain benefits and treatment for the condition, but he has to be the client and want the benefits/treatment.  As long as an authorized phsycian makes the referral or, you can obtain an IME, there is potential for treatment paid for by the insurance carrier.  ... Answered 8 years and 7 months ago by Mr. Christopher Edward Clark (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
Dear Anonymous,   If you miss more than 21 days of work from a work-related injury, you are entitled to Temporary Total Disability benefits (TTD).  TTD is 2/3 of your "average weekly wage."  If your injury is permament, you are entitled to payment for any Permanent Partial Impairment, (PPI).  Your PPI rating will be determined by the company's workers compensation doctor.  However, if you disagree with the company doctor's PPI rating, you can seek out a rating from a doctor of your own choosing.  You will have to pay for this evaluation.  If you have additional questions, you should contact an experienced workers compensation attorney.   Best,   Chip Clark... Can an employer refuse to adjust work start times that keep you from attending physical therapy?

Answered 8 years and 7 months ago by Michael Edward Fiffik (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
Did you have an attorney involved in your workers' comp claim?  If so, I'd direct this question to that person.  If his employer is governed by the Family and Medical Leave Act, he can request to take intermittent leave under FMLA to attend his therapy sessions.  A call or letter from an attorney would probably do a lot to get the employer to be more flexible as well. ... Answered 8 years and 8 months ago by Michael Edward Fiffik (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
The test result should not impact the compensability of his injury.  It should be reported to the workers comp insurance company and the claim processed.  If the company denies the claim, then you should seek counsel.
