How can I stop her from going if the court approved the move?

Answered 10 years ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
You cannot stop anything. You are the grandparent, not the parent. Grandparents have very limited rights under a statute passed to allow for visitation.

How can I change my son's name back?

Answered 10 years and a month ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
The reason that your son calls himself that and his social security card says what it does is because you taught him and filled out the forms incorrectly. You can't use your own poor decisions as justification for a name change. Notice has to go to the father of any attempt to change his name, and then the court will decide whether it happens. If you are now married and your husband would like to adopt, it certainly sounds like that could happen. Either way, an attorney in your community can prepare the appropriate petition to file in court.... Read More

What is the legal age of emancipation?

Answered 10 years and a month ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
Age is 18, whether you have graduated from high school or not. That goes both ways; your parents can throw you out whether you have graduated or not.

Child support in Indiana now terminates at age 19. If you are paying this money because of a child support order, then no. If it is for any other reason, then you need to explain what that reason is before an answer is given. (It would be very unusual that you pay child support top a store instead of the other parent).... Read More

No, the court who approved the guardianship has authority to determine where the children are. In Indiana, "filing for financial abandonment" does not mean anything. You should go to your local prosecutor's office and request enforcement of the support order (assuming there is one.) After you are remarried, you can consult with an attorney about adoption by your new husband.

Should I keep my son away from his father who is threatening me?

Answered 10 years and 2 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
Is his threat "Gee, I will come in the middle of the night and kidnap him", or more like "Gee, I will go to court and have the judge give me custody" The first should be reported to police; the second is not legally a "threat" at all.

How can my husband and I change my sonโ€™s name and him to adopt my child?

Answered 10 years and 3 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
Sit down and talk to an adoption attorney. There is nothing you can do without hiring a lawyer, and it sounds from these facts that an adoption would be successful; you do not necessarily have to have the father's permission to adopt.

The father has the right to ask the court to change custody. The court decides, not the parents, unless the parents can agree on what should happen.

It is a negative factor, but probably will not be a major one in the court's decision making.

1. Place the child for adoption 2. If you choose not to do the first option, when he seeks visitation, ask that it be supervised. As a parent, he has rights that were created about 8 months ago, and it may be quite a struggle to continue to deal with this father because of the choice that you made, but raising your baby means that you are willing to deal with that struggle.... Sevice Member moving to Hawaii, wants child for the summer.

Answered 10 years and 5 months ago by Andrew Jon Thompson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
You have good prospects of obtaining what you desire, however, she could make it a difficult process.  I suggest getting started now so you can have it resolved by Summer.  If she wants to, she can make it a very challenging and expensive process - but if you take the right steps, there is a very good chance you will get something close to what you want.... "Her papers" and "what her parents tell her" are phrases that indicate to me someone wants to play games. When one is 18 they can move anywhere they want, and can no longer expect any support from their parents if they do so. Your gf knows how old she is. If she doesn't, you should not have a relationship with her until she confirms her age and gets a checkup to make sure she is a mentally competent adult.... Read More

What will happen if I up and move out of my residential state and relocate my son?

Answered 10 years and 5 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
If you do this without complying with the statute regarding relocation notice, a lot can happen, including loss of custody. If you do it with notice, and if she objects, after court approval, nothing other than a change in parenting time for her.

What do I have to do to get emergency custody?

Answered 10 years and 5 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
This is a very confusing question. Do you want custody, or do you want to disown her if she is not your biological child? (If you did not contest that issue in the divorce, it is probably too late anyway.) There is no emergency here; you simply need to file a request to change custody to yourself. I advise you to get the help of a lawyer to make sure you are successful.... Read More
