This will all revolve around the nature of the damage to the engine, bearing in mind that you first appeared at tire kingdom with the check engine light on, which could give them a defense that the damage was done prior. Assuming you can prove they did something to damage the engine and requie its replacement, you may have retain a lawyer and spend some money suing TK for the damages if they refuse to make right the damages they caused. If you have other questions, please fee free to contact our office at 1-800-922-6442 for a FREE consultation. ... Its not a sellers job to warn you or educate you about the transaction. Your issue is about expectation of a refund AFTER purchase, where in most instances, there simply is none for such items. Any doubt, go to Best Buy and purchase software open it up, install it, and try to return it. Before you buy anything, you need to ask such questions, actually read the terms and conditions of the licensing agreement (not just click yes to install), etc. If you have other questions, please fee free to contact our office at 1-800-922-6442 for a FREE consultation. ... You may have claims under the Florida Motor Vehicle Repair Act, or Florida Unfair and Deceptive Trade Practices Act. The bigger issue is whether or not you are willing fund the lawyers fees and costs pursuing such a case.

Possibly niether. I am unaware of any provision that would prevent someone from selling a clipped car in Florida. Fla. Stat. 501 may help  BUT you would have to provide you asked specific questions to show seller misrepped condition rather than just didn't inform or that the title from DMV was obtained by fraud somehow. ... Its impossible to tell without looking at all the documents and details. Why people will enter into contracts for cars often costing as much or more than a house, and never think to hire lawyers to review the paper work in advance I simply will NEVER understand. In your situation "you making it clear" is not a proper legal standard, as this should have been spelled out in writing so there was no further confusion. HOPEFULLY, this will work out for you with no hitches. IF it goes south, you may find yourself spending a signficant amountof attorney's fees to try to sort it all out since your asking about legal rights and obligations AFTER the deal was done. ... Absent some direct evidence, like an insider or whistle blower, 99.9% of lawyers will not look at such a case on a contingent fee. This does not mean you can't sue or gather evicence, only that you will likely need to retain a lawyer to do this in the traditional manner, at your expense. If you have further questions or concerns, you can call our office at 1-800-922-6442 for a FREE consultation... How to file a lawsuit for a failure deliver merchandise

YOU wont be able to file a lawsuit like this competently, so I would advise against even trying. This is supported by the poor decision making leading to being in this position in the first place. If you intend to actually file such a lawsuit, you will likely need to retain an attorney, typically at a pre-paid retainer/hourly rate as the lawsuit desribe is likely very complicated. In the future, you shoudl investigate the numerous other means of making such purchases in a manner that provides more protection for your transactions, and if this was a commercial event, retaining a proper corporate lawyer to help you establish better policies in the future....
