Do I have a case for false advertisement?

Answered 9 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Not likely as there are often changes and programming issues with various manufactuers. While I am sure you would be happy with the extra device at the door opener companies expense, they may oppose this as much a you might equally be happy with carmanufactuer making thier car compliant at thier expense. You may have a Mag-Moss warranty issue or a false advertisement claim to pursue but this will all revolve around the terms and conditions of the sale and warranty documents, ut such cases are not inexpensive and you may have to pay legal fees up front and seek reimbursment later. You may just need to return the item for a refund if possible or simply by the additional component. ... Read More

The dealer is likely right. You generally dont get to sign contracts and the back out later because you changed your mind about what you can afford. You do that BEFORE you buy things. If you insist on trying to get out of the deal - you will need to retain a lawyer to handle this and it may not be successful depending on what you signed. ... Read More

There is no case here. As your personal security is an issue YOU need to be more diligent about when or how that information is revealed and the manner in which that occurs. There is not likely a viable claim here. In the future, you need to accept the inconveniences of maintaining personal secuirty, which would likely require face to face transmittal of such information or other methods such as using encrypted files, etc. ... You brother is dirtbag criminal thief and you need to keep as far away from him for ANY financial dealings. This means getting off of ALL accounts with him or where he has any interaction at all. Properly you should advice the sellers of the "error" and make proper payment for the items if they were items you purchased since you said "we purchased". ... Read More

Late fees accessed by wamart

Answered 9 years and 2 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
If you make payments at the last second - you run the risk of all kinds of unnecessary issues to deal with. It is equally unlikely that your payment due date is the 5th as opposed a grace period for late fees applying until the 5th. You better bet is to pay BEFORE the due date not wait until the last second or try to work an issue of mere hours regarding payment. ... Read More

What should I do?

Answered 9 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
I am gonna use my "spidey sense" here as I suspect this was another of many purchased vehicles over the internet sight unseenwith no independent inspection. If so, you maylikely find that the risk of such a purchase have come to roost and the expense of soirting it out may outweigh the expense of repairing the vehicle at your expense. Otherwise the liabilities will attach to the bill of lading as to who is responsible for the vehicle and who the delivery people legally worked for. Typically such items are FOB the dealer lot and your responsibility for transporting. ... Read More
