Chap. 83/715. if they failed to compmy with the notice provisions and dispose of the property properly, they may owe you damages for the losses you can prove. Unfortunately, such cases are not often contingent fee cases so you may need to plan on spending money out of pocket on a lawyer and look to get your money reimbursed if you win.  ... Read More

This sounds like some stipulation from a lawsuit with "being of record". That stated, the loan agreement is the deal, anything else other than a written change to the agreement is a courtesy. If you can't pay for the car and they wont budge, they will likely repossess the car.

The problem is that business people arenot expected to make personal decisions or special considerations for others. That is the responsibility fo freinds and family. If your Uncle is that disabled that he cannot make proper decisons then he needs to get to a guardianship lawyer and have a guardian appointed. That aside this will be a difficult as you are comng in after the fact, so your first issue is to presumably cancel the coverage. THEN you can retain a lawyer for your Uncle to review the situation and see whether there was some impropriety that occurred as its impossible to tell what you are basing "billed as an accident policy" and then called a "rebate program" as neither makes any sense in a vacuum, suggesting that this is all likely incorrect also. ... No real damages and the worst possible defendant for such claims dictate that this is a no starter for a proper injury claim. You can try to see what you can get from them - but most competent lawyers would not pursue such a claim on a contingent fee.

"Fair" has nothing to do with contract obligations, as "fair"needs to be addresed BEFORE you sign an agreement or buy a product. You will need to retain a lawyer, probably at some initial expense, to review your warranty agreement and the situation, and probably file suit if the insurer won't abide by the agreement. By example, not changing the timing belt would have little to do with replacing a covered window motor BUT could be serious and legitimate issue if there was engine damage caused by a bad timing belt or the engine being out of timing. Little guys don't win when they make poor legal and finaincial decisions. While its laudable that she spends her money on others, that does not get her credit for her own debts or obligations. Not sure what the dealer is expected to do as Wells Fargo is the lender and they have control over the loan. If she is seriously in debt she may want to consider bankruptcy. ... Read More

If i purchase a car and cant make my first payment , and asked for a 2 week extension , can they reposess my car ?

Good afternoon Im sorry to hear that. The pratical answer will be to definetely contact your car lender and ask for the extension. However, legally speaking, under your security agreement, the general forms used by car lenders will have a provision or clause in the agreement that states that if you are even 1 day late, they have the right to repossess the car and accelerate your note (rather then the amount owed, the full amount owed on the car itself) Nonetheless, contact your lender for some time. The larger lenders usually are accomodating if you keep them up to date and as long as you get caught within the time frame that you are requesting. If you are dealing with smaller lenders or in-house finance places, they are usually harder to deal with. If your car does unfortunately get repossessed, here in Texas, you have 10 days to recover the vehicle. Usually your options are limited, but 1st option will be to call your lender and ask how much they are asking for to release the car. Keep in mind they can ask for just the amount behind + the repo cost (generally between 600 or more) or they could have accelerated the car note and may ask for the full amount owed plus the repo cost 2nd - if the amount requested is too much, you can file a Chp13 bankruptcy which at the time of filing the car lender will have to release the car back to you. They cannot charge you any fees upfront (but can include the repo cost in your bankruptcy case). At least with the chp 13 you can get your car back sooner with less cost. Hope this help!
