the fact pattern you outline would give protection to both the police and the school with regard to discrimination. the allegation of the shoplifting on the video camera would give them 'reasonable suspicion' to support the 'stop'. the 'pat down' by the officer is supported by the 'self protection' of the officer.  the officer is also allowed to ask for your identification to insure that you are who you are.  ed dimon, esq.... the manager did not use good judgment in speaking to the children in a negative manner about their father. however, unless we can demonstrate that your husband lost the job based upon discrimination, there is no basis for a claim of action. the discrimination would have to be based upon race, religion, sexual orientation, etc.  ed dimon, esq.... the key is being able to prove the allegations. you need to prove that you have the same job as the others who are receiving more money and have the same or better 'work accomplishments'. i doubt that the better paid co-workers or employer will provide us with this data. i can have our private investigator meet with you to determine what we can and cannot prove. the problem is that you risk losing your job if the 'proofs' are not 'rock solid'. ed dimon, esq.... the police may 'stop' a person if they reasonably believe that a law has been broken. for example, a borken taillight or tinted windows. after the 'stop', the police can demand an id and proper registration and insurance.  did your son have the proper registration and insurance documents ? if not, the car can be towed. if vineland police are stopping the cars of your friends, they should call '911' when they are stopped and give a detailed account of what is happening. these are recorded calls. this will end the 'stops' if they are illegal. please let us know if we can help your son. ed dimon, esq.... Answered 13 years ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer
the 'devil is in the details'. the gym teacher should be specific in the 'written explanation' as to why your son cannot participate. you can then address the specific reasons. the reasons would have to be based upon 'safety' for them to be upheld.
