Claim against funeral home

Answered 7 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Personal Injury
Yes, you may have a case. Only immediate relatives of a decedent who has been treated with disrespect during the funeral home process can have a claim. Hopefully the new funeral home took photographs that can prove the tortious interference with the decedent. This platform prohibits attorneys from soliciting cases from those posting questions, but you're welcome to research your background and reach out to one of us privately. ... Read More

Should I settle?

Answered 7 years and 6 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
it is impossible to give a fair amount to settle wihtout reviewing the entire file.  Would need to consider fault, permanacy, review medical records etc.  If you have a laywer discuss with them.  If not you may have made a mistake trying to settle without an attorney and may have damaged your case.  If you are not represented stop communication with the defendant and call an attorney.... Can I sue a nursing home for breaking my wife's arm. I can't find a lawyer to take the case.

Answered 7 years and 7 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
I'm not sure who you have discussed with but I would continue to look in your area and if the case is turned down ask the attorney why the case is not worth pursuing.  Indiana Medical Malpractice cases are difficult, time consuming and expensive to undertake.

Making the case against the state is going to be difficult because of the law in Indiana (If you're foudn to be 1% at fault you get $0.00). You may have a case against the maker of the bracelet, but you'll need to find a products liability lawyer to handle that type of case.

what type of attorney would I need for a case where my car seating heating element is burning my skin

Answered 8 years and 4 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Any personal injury attorney could handle this matter.  The question is if you want to pursue.  An attorney would need to know the facts regarding how you were injured.  Was there a malfunction etc?  Also, what are the nature of the burns.  If they were minor burns (i.e first degree) then you may not want to pursue.  Speak with an attorney.  ... You can but the question is should you.  That will depend on the specific facts and the nature of the injury.  Before you speak with anyone from the store or their insurance company speak with an attorney.  An attorney can tell you if you should pursue.

How much contingency fee must an attorney get?

Answered 8 years and 6 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Personal Injury
It is actually illegal for an attorney to finance your case, i.e. give you money for expenses etc. to prompt a case to be pursued. So this agreement is fairly standard. Having said that, our firm has never had a client pay the full share of such costs, and no money is spent for which a client might have to bear responsibility after a lost case without obtaining approval from the client of the expenditure. You should ask your attorney more questions about what is intended here to try to clear up any confusion.... Read More

How do I file c case for negligence for my father?

Answered 8 years and 6 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Personal Injury
You need to talk to an attorney who specializes in medical malpractice cases. That consultation will typically be free, and the attorney can explain the process by which a claim is pursued. It is NOT something you can do on your own for your father in any fashion.

Yes, you can sue Dairy Queen. It will likely be a difficult case which will take a decent amount of time to resolve. Large companies don't tend to settle things early in the process. I hope your daughter is okay.
