Answered 3 years and 9 months ago by attorney Gilbert Borman   |   1 Answer
It is not clear to me what you are asking. You seem to be describing a situation in which an officer's wife is the judge in a matter, my answer is to that fact situation: This is called a conflict of interest and the judge should recuse herself from the matter. Advise the court through a motion to recuse. If the judge refuses to recuse, appeal that decision.   Good luck... Read More

Answered 3 years and 10 months ago by attorney Gilbert Borman   |   1 Answer
Certain components that can be used for nuclear and advanced weapon systems are controlled under US law. Additionally, eBay has its own rules of what can and cannot be sold (weapons are not permitted). Where you also face issues is shipping to other countries because certain goods are not permitted to be sold to Iran, N. Korea etc. One would have to know a lot more about what you are selling to advise you more. ... Read More

A US citizen spouse can sponsor her foreign national spouse for a green card despite the overstay. You should work with an attorney. Some of us charge a very affordable flat fee to process and handle the case from start to finish. By filing a G 28 notice of appearance in the case, duplicate notices will go to the counsel of record so that the case can go smoothly and without complications. You can retain counsel anywhere in the United States for representation.... Read More

You may have a claim against the store for defamation of character. A false statement was made and was presumably published to a third-party, and that constitutes slander per se, which means you do not have to prove damages. When any plaintiff files a lawsuit against a defendant for defamation, they have to prove that they have been damaged. However 'slander per se' allows a plaintiff to recover damages without the need of proving same, if the statement falls into either of four categories. 1. Youve been accused of having a loathsome disease 2. You have been accused of a crime, 3. You have been accused of being a person of ill repute, or 4. You have been accused of being dishonest in their business dealings. Finally, there should be a source of recovery because 99% of the time commercial businesses like this have insurance policies that cover advertising injuries. That is a fancy word that means that defamation is an insurable risk that commercial enterprises protect themselves against. So what you should do is to retain counsel to represent you, and have a claim filed against the business. If they refuse to negotiate with you or you do not have any luck in finding a lawyer to represent you, you can always file a lawsuit against the business in small claims court.... Read More

How do I go about having a Will notarized?

Answered 4 years and a month ago by attorney Hon. Max L Rosenberg   |   1 Answer
Do not write your own will.  If it is important to you, have an experienced attorney draft it per your specification and they will provide witnesses and a notary.  People who create their own will using online forms are at risk for not complying with state law and other finer points that may become important. Please do not be pennywise and pound foolish.  It is a very important endeavor. A simple will with an attorney should not cost more than 1,000. and may be as low as several hundred dollars depending on where you go. I would advise you to research lawyers on Avvo.com.  Good luck.... Read More
