Can a former employer withhold earned vacation pay

Answered 11 years and 8 months ago by attorney Matthew James Porter Coffman   |   1 Answer   |  Legal Topics: Employment
There is no law requiring an employer to pay you unused vacation time at your separation from a company whether the separation is the result of a termination, resignation, or otherwise. What can I do if my employer is harassing me?

Answered 11 years and 8 months ago by attorney Matthew James Porter Coffman   |   1 Answer   |  Legal Topics: Employment
How many employees does your employer have? If your employer has 50 employees at your location or within a 75 mile radius, you may be entitled to FMLA leave (assuming you have worked at least 1250 hours and been employed for at least the last 12 months). You may also want to contact a workers' compensation attorney to discuss whether you should pursue a claim for your injuries. If your employer retaliates against you for filing a workers' compensation claim you have a legal claim against them. Another issue that you identified is the safety equipment you are wearing. If you employer is violating OSHA regulations you could report those and you would be protected from retaliation. Unfortunately mechanics can be compensated on a salary basis so there is no claim related to all the hours you are working.   Ohio employment attorney www.mcoffmanlegal.com ... Read More
