Unless you are n the BOD, why do you care about the details of what the bad board member can or cannot do or what "evidence" can be considered in a recal proceeding? If you ARE on the board, then this question can only be answered by the lawyer representing the board and familiar with the procedural requirements for a recall. ... Read Answer

Hmmmmmm there is OBVIOUSLY something else goin on here as these facts and the victimization make ZERO sense. That said, if the debt was fully paid, its hard to understand why all of this went on, especially since it should have ended the next day when you returnd and paid your tab. Now is where you respond with "well wha ha happen whuz....". Regardless, this may be a collections practices violation at several levels if what you are saying is actually and accurately true. You should consult with a consumer lawyer in that regard if you like. ... Read Answer

Posting a public record of you called "doxxing" is not defamatory nor inherently actionable. Depending on the names or other statements made, there may be some actionable comments to support a lawsuit. Such cases are typically NOT handled by lawyers on a contingent fee so be pepared to pay legal fees out of pocket for a such a case. ... Read Answer

Not likely - disagreeing or being offended does not make the other persons filig a complaint malicious nor defamatory. It would require much more like evicende of an ongoing personal vendetta unrelated to the teaching environment or such. Also such cases are typically NOT contingent fee cases so you will have to bear the expense of hiring a lawyer out of pocket. ... Read Answer

Possibly. It will depend on the details and whether you want to spend the money to hire a lawyer to take such action for you. These are not typically cintingent fee cases like car accidents.

You will probably need to hire a lawyer and maybe a computer expert to track down and ID of the person and then decide what action to take from there. Such cases are expensive but often necessary to vindicate the company reputation which can cost far far more in lost business.

Because you have no idea what you are actually saying or doing from a legal perspective and because an claimed victim letter saying "stop it!..." will usually be laughable to the claimed offender, or worse make threats that you can't or wont back up like "if you don't stop the conduct I will hire a lawyer and sue you! and for punitive damages and everything you own!!!!!...!!!!" I can't tell you how many defamation consults I have had where they intimate legal action AND THEN when whey realize the cost and that lawyer wont take defamation cases on a coningent fee, are left looking impotent and stupid which often emboldens the other party to ramp up the issues even more. ... You can hire any lawyer you want send such a letter - its simply a matter of spending the money to do so. Be aware that C&D letters in romantic disputes often do little more than drive the other person to be more sneaky. Youmay need to either simply file suit, at a significant legal expense, or find a means to disangage from interaction with him. ... Read Answer

Unless he is a minor, your son, not you needs to be addressing such issues with lawyers. How do I know what type of law attorney to look for?

YOu have Google lawyered yourself into a tizzy- as shown by the regurgitation of "qualified privilege". Don't do that as you will make things get out of control quickly. There is generally no privilegeor privcy you enjoy relative to an employer telling people of your termination. You DO have the right to not have people defame you by FALSELY spreading lies about the issue though. If by example, you were fired becaue you came in late and you can prove managers told people you were stealing, there would be an issue. That stated, you are looking for a civil trial lawyer for any defamation case and employment law if you feel there was some illegallity to your terminaton.... Read Answer

It could be - but there are a number of complications here. If he was charged as such, there may be information the state has that is either incorrect or confused with someone else with a similar name or alias. He will need to have his criminal lawyer sort this out ASAP and then go from there.... Read Answer

You will need to unfortunately bear the expense of hiring a lawyer to file such a lawsuit as they are very high risk and often expensive lawsuits to begin with and doubly so when non-lawyers think they can prosecute such cases pro-se. We actually handle such cases fairly frequently, and I can tell you the biggest issue in such matters is the financial expense. ... Read Answer

Its not a defamation case at all. This is a "revenge porn" case. You can report this to law enforcement for potential criminal prosecution. If you want to sue for civilly damages there are several ways to do this, unfortunately, these are typically hourly rate/retainer cases and such litugation is typivally exensive to pursue. ... There are several issues that may have legal remedy, the problem is more financial than legal. If you can't make rent, you won't likely be able to hire a lawyer to address and defamation type case, as they are typically not taken on a contingent fee basis with no recovery no fee. Such cases are often expensive to pursue and high risk as far as financial recovery. The obvous issue is that if your freind were generous enough to let you stay with them and you have worn out your welcome, you will need to leave and go elsewhere. ... Read Answer

business defamation suit, what is needed?

We actually handle a number of these cases. Typical these are social media/internet defamation/tortious interference cases. To be clear they are NOT contingent fee cases but are handled on a retainer/hourly rate. The key is to be sure that the business wants to invest several thousand dollars up front to take the offender to task. If the answer is no, whether through lack of funds or not wanting to have the expenditure, then pursing such a lawsuit is simply not feasible. Many of our client however choose to weigh both the expense of letting false statement go unchallenged giving it credibility and the financial impact on the business, as part of the equation, which can often cost far far more. If you wish to discuss the details of retaining our office, please feel free to contact us at 1-800-922-6442.... Read Answer
