No. You indicate that they told you he didnt need surgery but told you to follow up with ortho surgeon. That simply is inconsistent and suggests you misinterpeted EMERGENCY surgery vs. any surgery at all. You then follow up next day with ortho surgeon who performs surgery a week later and equally did not perform emergency surgery. Unless you obtain a written opinion from an othopedic surgeon that the lack of emergency surgery had some catastrophic impact on your child, there is not likely a case here at all.... Read Answer

First, lawyers dont "give you" an amount on a case. If the case settled for a value, you necessarily would have been required to accept same and sign a release, etc. That makes it VERY hard to blame a lawyer because you now feel you should have gotten more. In this event, you will have to retain a lawyer as an expert to examine your case to see IF the settlement or judgment was somehow so low that the lawyer was somehow responsible.  If the amount you reference is an improper calculation for settlement. i.e. the lawyer charged 40% and he should have charged 33 1/3% you can contact the Florida Bar regarding a  "Fee Dispute " and they can provide you some other options you may want to explore. I'm sorry to hear about this.  You need to find a lawyer licensed in the state where you were injured/where the mistake was made.  If the injury occurred in Alabama, for example, you need to hire an attorney licensed in Alabama.  You may be able to find an attorney licensed both in Florida and in the state where the mistake was made, but the lawsuit would still have to be filed in the other state. Call the Florida Department of Professional Regulation and they can refer you to the proper board to make a complaint about the doctors refusal to release the records. As long as you are willing pay for the records copying, the doctor is requied to provide them too you as a general rule.
