Grandmother misdiagnosed by family doctor

Answered 11 years and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Medical Malpractice
ZERO. In order to prosecute such a case you would have to be the personal representative of her estate as appointed by the court and her will. Second, unless lung cancer could be corrected or cured within the few days between misdiagnosis and proper diagnosis, there are no damages that are likely to be recovered. Simply having a misdiagnosis without damages is not enough for a medical malpractice case.If you are appointed PR, then you will need to gather all of her medical records and then retain a local lawyer that handles med mal cases to review the file. This may entail hiring a medical expert for this purpose also as an expense to the estate. If you have further questions, please call our office at 1-800-922-6442 for a FREE consultation.... I suspect this was more than a simple cautionary "honk" and there was more to this confrontation. Your entitlement to be in the program revolves around hwo you got ther and the terms and conditions of it. If its voluntary and at the will of the doctor, you likely have no recourse but to find another program or therapist. Doubtful. I am pretty confident that your insurance does not REQUIRE that you only purchase your medication at a single location. I would take your business elsewhere. Just be aware that is voicing your opinion about someone, you are responible for the result, and this may mean people dont want to deal with you. Can I sue chiropractor for being injured?

Answered 11 years and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Medical Malpractice
Posibbly. BUT you will have to prove the manipulation was the cause, and a value in damages that makes it financially worth pursuing, which may be difficult, unless the injury was immediate and you went to the hospital by ambulance or something like that. Starting point is a written opinion from a doctor establishing the malpractice.... Read More

is it worth trying to sue

Answered 11 years and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Medical Malpractice
Hard to tell on the facts as there appears to be little actual damage, other than brief period of pain. Should be reported to Risk Management and possiblly to the licesning board for the tech, presumably the Nursing Board for the State of Florida.

Possibly. You'll need to get a medical opinion as to whether this was the resilt of malpractice or a know complication. A bad result alone does not give rise to a medical malpractice case unfortunately, so you have to clearly distinguish that type of issue.

Hopefully nothing happened with your DVT to cause you damage, like stroke, heart problems, etc. Assuming the hospital misdiagnosed your blood clot (DVT), absent some documented damages, not pain (as this could be from clot irrespective of diagnosis) you have to have some significant damages to really warrant a review for malpractice unless you are willing and able to fund the medical review. If you have other questions, please fee free to contact our office at 1-800-922-6442 for a FREE consultation. ... Visit Dr.

Answered 11 years and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Medical Malpractice
Is it ok to be a patient and for reasons unknown seem to have personal conflict issues with numerous unrelated physicians and not reflect that it might be something the patient is doing? From what you describe, the common denominator appears to be how you are interacting with your healthcare providers, and I presume from the contents of your post, that this involves some level of confrontation and accusation by you that seems to be alienating them. If you expect to get decent healthcare at all, you may need to examine what it is that you are doing in your interaction with these various and unrelated providers that all come to the same conclusion, they don't want to deal with you. If its the manner in whcih you express legitimate concerns, you may need to find a more effective means of communicating such things. If you have other questions, please fee free to contact our office at 1-800-922-6442 for a FREE consultation. ... Answered 11 years and 7 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Medical Malpractice
The issue here is determining what the misdiagnosis of fx C2 vertebra caused as far as additional injury or harm and what could have been done differently given the age and condition of the patient. From a civil perspective, there would need to be more than a termporary abilility to sit up. Should you have any questions or concerns, please feel free to contact our office at 1-800-922-6442 for a FREE consultation. ... can i file a malpractice suit against a va clinic doctor

Answered 11 years and 7 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Medical Malpractice
You can file admin complaints, but I doubt you will get far with a malpractice suit. Unfortunately the rampant abuse of opiates and other narcotics has led to clamp down on such prescriptions and there is a clear trend in defending doctors against such issues. If you have further questions, please feel free to contact our offices at 1-800-922-6442 for FREE consultation. ...
