From what you describe it sounds as though you and your spouse separated when you each walked away and started living separately. Assuming your injury occurred after the physical separation, your ex would not be entitled to part of your bodily injury claim unless community property was used to pay your expenses related to the injury. Since you separated so long ago, that seems unlikely.

This question is a family law question. But I can see how you mistakenly believe this question is an immigration question because two foreign nationals living in two different countries are involved.
That said, most states will grant a divorce even if both parties are not within the state’s jurisdiction (which includes parties living outside of the United States).
I recommend you speak to a California family law attorney to properly advise you on this issue.

No. Everything you have earned post-separation is yours. Just make sure you don't comingle your earnings (combine it) with assets or accounts that you both owned during the marriage.
File for child support. You can go to Child Support Services in the county you live in. You can visit the website for child support, they have a child support calculator where you can enter your income, his income and the percentage of custody he has (In this case ZERO) and you will get a guideline amount of how much he would have to pay you for Child Support.
Or you can hire a competent family law attorney that can assist you in obtaining a divorce, custody and child support.

Good morning. In the family courts, there are two kinds of custody orders, temporary vs. permanent. Temporary orders are all orders made short of trial/evidentiary hearing. Permanent orders are made only following trial and are more difficult to modify. However, so long as one or more minor remain under the age of 18, the faily court has continuing and exclusive jurisdiction over all custody and visitaiton issues.
Therefore, unlike a divorce, there is no true END to custody proceedings until such time that the minor(s) age out.
Unfortunatey, it sounds like the court process has been less than expedient for you. However, the only way to truly expedite this is to notice an emergency application of some sort. Of course, refrain from doing so unless there is an actual emergency.

It is best to go through the uncontested divorce while you meet the jurisdiction and residency requirements to qualify for divorce in CA. If you move prior to divorce, you may not be able to petition the court for divorce in OR. Sounds like you need an attorney that specializes in defending fathers like my office. However, we are in New York and do travel for cases, which is not cheap. However, if you are willing to represent yourself in court and or if you are in one the counties where we do have a partner attorney we can send them out on our behalf for your case. I don't know how other attorneys would view your case, as we have an expertise and specialize in defending fathers, to me it seems an easy case. She might get herself a free pro bono attorney which might only make the process a bit longer than usual, compared to if she would be paying a lawyer. As long as there is no court case pending, or a decision granted in court, you both are still married and have responsibilities to carry on regular life like you guys have or had. The decision to pay the bills and contribute towards the house expenses is an individual owns decision and the actions speak louder than words. If he leaves you stranded, you can use that when you are fighting for alimony in court and have him back-pay anything and everything you can get.
