Answered 8 years and 7 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
The statute governs regardless of what the plea agreement says. However, T.C.A. § 40-39-207, titled "Petition to terminate offender participation in registration program; record expungement; registration for life for juvenile offenders" says: "Except as otherwise provided in subdivision (a)(3), no sooner than ten (10) years after termination of active supervision on probation, parole or any other alternative to incarceration, or no sooner than ten (10) years after discharge from incarceration without supervision, an offender required to register under this part may file a request for termination of registration requirements with TBI headquarters in Nashville."   ... Been Placed on Meganโ€™s Law illegally.

Answered 8 years and 7 months ago by Ryan L Hyde (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
Megan's law is certainly a tricky subject and the challenge is that it is never a part of negotiations because it is mandatory with certain charges.  There is new Supreme Court law in the Commonwealth of Pennsylvania regarding retroactive application.  You should consult with a local defense attorney, one who does appellate work and see if you can challenge the application of the law.  One of things you have to do is be careful ignoring it.  Failure to register is its own penalty and can carry large sentences in and of its own right.  There are many defense attorneys in the Bensalem and Philadelphia area who are skilled with this kind of case.  Challenging it will be a timely process, one best handled by an experienced attorney. ... Is it illegal for a 15 year old to date an 18 year old?

Answered 8 years and 11 months ago by Kenneth Oliver Wang (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
You're confusing whether it is illegal, and whether it can be proven. It is illegal if you have sex with him. Whether anybody can prove it or not depends on the facts and circumstances of the case. If your boyfriend is found guilty, he could be required to register as a sex offender for many years, along with face a fine and potential jail time.  ... Read More

Answered 9 years ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
While your reading of the definition of statutory rape is correct, if you think that I am going to tell you that it is okay to have sex with a minor,  then you are mistaken. Proceed at your own risk.

Is it possible for someone who is 18 to date a 15 year old.

Answered 9 years and a month ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
Understand that your girlfriend is 15 and a minor. As such, she is under the authority of her parents who have the rights to make decisions for her. I would suggest that you work within the guidelines that her parents have set down for dating. Do not rush things and let them develope and before you know it she will be 18 and legally able to make up her mind as to what she wants to do.  Do not do anything stupid like running off to try and get married. Also, do not have sex with her as the age difference could get you arrested.  ... Read More

my questions is what legal rights do I have if any and what do I do?

Answered 9 years and 7 months ago by attorney Renea Overstreet   |   1 Answer   |  Legal Topics: Sex Crimes
You have the right to pursue an access and possession schedule with your children. If they haven't seen you in a long time, you would probably want to seek some counseling either through court services or some other free or low-cost service. Along with access and possession, you would likely be ordered to pay child support. That shouldn't deter you from seeking a relationship with your children. Child support is based on your income.  You would have to decide whether you want to make a police report about statutory rape charges against the woman. According to Texas law, you were not able to consent to sex until you turned 18, so her relationship with you was never legal if she left before you turned 17. You probably should report her.... Am I at serious fault for send an inappropriate pic to a 16yr old?

Answered 9 years and 7 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Sex Crimes
You made a bad decision in sending a picture of your private part to anyone and I would suggest that you not do it again. Sending such a picture to a minor is a felony even if you thought or was told that she was 18. However, this sounds like a scam to me.  I would suggest that you break off all comminication with "her dad"....
