I need a lawyer for a toll violation case

Answered 5 months ago by attorney Michael A. Schillinger, Esq.   |   1 Answer   |  Legal Topics: Traffic Violations
Depending upon where you received your violation for a suspended registration, the courts handle the cases differently. Some courts will not resolve the case until you rectify the underlying suspended registration - if this is stemming from an overdue ezpass bill, this can often be difficult and costly to clear up. Oftentimes though, courts will be more willing to considser a resolution if you demonstrate efforts that you are clearing up the EZ Pass bill or setting up a payment plan. Once the suspended registration has been cleared, it's often possible to have the case reduced to a violation or even an adjournment in contemplation of dismissal, where the case is eventually dismissed and sealed. ... Fire hydrant accident on 4th of july penalties

Answered a year and 7 months ago by attorney J. Allen Fiorletta   |   1 Answer   |  Legal Topics: Traffic Violations
Good morning... If a detective or other law enforcement officer wants to speak with you, it is likely that they are investigating whether a criminal offense was committed. We never advise our clients to speak with law enforcement, at least not without an attorney present. I would be happy to discuss your situation in detail with you if you would like to give us a call.... Read More

You would need to see about having the admission of responsibility withdrawn and have the matter set for either an informal hearing (you, without a lawyer) or a formal hering (you, with a lawyer). With a formal hearing, your attorney could seek to resolve the matter in such a way that you do not receive points on your driving record.... Read More

Do I have a case

Answered 2 years and 5 months ago by Mr. John Michael Frick (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
It does not sound like you have any sort of case, much less one in the area of legal ethics and professional responsibility. It sounds like you received a traffic ticket and it was dismissed without prejudice three weeks later because of the executive order temporarily suspending vehicle registration enforcement. It also sounds like you did not sustain any legally compensale damages, such as the expense of hiring an attorney.  So even if your rights were violated as you claim, how were damaged monetarily?Even assuming you hired an attorney to handle the ticket, most such attorneys charge relatively low fees.  Would it really be worthwhile to hire a litigator and to pay tens of thousands of dollars to recover whatever you paid the attorney to handle your ticket for you?... Why is my license suspended?

Answered 2 years and 6 months ago by attorney Diane Buerger   |   1 Answer   |  Legal Topics: Traffic Violations
It is not possible to tell, by the information you provided, why your driver's license was suspended.  You should re-read the 20-day Notice letter that you received from the DMV - Florida Dept. of Motor Vehicles and Highway Safety (i.e., the letter notifying you of the suspension) to see if it states the reason. Otherwise, you should be able to go to your local DMV Office in person.  You may have to make an appointment.  That office should be able to explain why your driver's license has been suspended and how to get it reinstated. The following are among the usual reasons for driver license suspensions in Florida: 1.  too many traffic tickets (i.e., too many points) within a set period of time; 2.  DUI; 3.  leaving the scene of an accident; 4.  failure to pay child support; 5.  failure to appear for a court hearing and pay a court fine; 6.  failure to pay a traffic ticket; 7.  lapse of vehicle insurance 8.  medical     ... Can I countersue from an auto accident?

Answered 2 years and 9 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Traffic Violations
Yes, it looks like you may have a claim against the driver who you feel was negligent. Police reports are not dispositive of civil liability. You should consult with an attorney here in the state of Florida for  contingency fee representation, which means you don't pay anything, unless you win. Also, under the PIP law here in Florida, accident victims must seek medical attention within 14 days of the accident to preserve their personal injury protection benefits in their insurance policy.      ... How can I get a copy of traffic cam video footage to prove I was innocent of a citation?

Answered 3 years and 6 months ago by William Melton (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
If you're referring to the cameras on the street lights, they do not record. They are live feed only. If you have been cited for reckless driving you need to consult an attorney. Reckless driving is a class B misdemeanor. Not only will it go on your criminal record, but it will substantially raise your car insurance. I've even some some insurance companies drop drivers for it. Contact an attorney asap.... Read More

Can I get a ticket for sitting in the driver seat while the car is parked. I was working in the car.

Answered 3 years and 6 months ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
You don't say what the ticket was for but most traffic tickets would require that the car was being driven, r case of things like DUI, that you had 'actual physical control' of the car.  If the car was inoperable, then it would be unlikley one could be convicted of any offense requiring 'driving' or 'actual physical control'. ... They didnโ€™t reduce my speeding ticket

Answered 4 years and a month ago by attorney Michael A. Schillinger, Esq.   |   1 Answer   |  Legal Topics: Traffic Violations
I'm sure you don't want to hear this but you should contact a traffic lawyer in your jurisdiction as soon as possible. Depending on the jurisdiction that you live in, the prosecutor's office may or may not negotiate with dropping points or reducing the ticket, but if they negotiate then your attorney will know best how to negotiate with the prosecutor on your behalf. However, if you live in a jurisdiction like NYC, the traffic violations bureau does NOT negotiate at all. In that case, you would want to take the ticket to trial, and certainly you would want to have the best representation when it comes to conducting a traffic court trial, cross examining the Police Officer, and presenting evidence on your behalf.    I hope this information is helpful. ... I got a speeding ticket for 16 and over, but I was never pulled over

Can a police officer site a ticket for something that happened in another county that he has no jurisdiction?

Answered 4 years and 2 months ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
If the 'crime' occured int he officers county but the 'arrest' or 'stop' occured in anotehr county, it is probably okay if the officer was in 'hot pursuit'  of the perpetrator into the other county. BUT it is an issue that a defense lawyer may be able to use in the case. It depends a lot on the specific situation.... Read More

If tickets issued had all vehicles information wrong can they be thrown out

Answered 4 years and 3 months ago by Mr. Gary Kollin (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
If the only thing wrong is the make and model of the vehicle, then the tickets will not be thrown out. It goes to credibility at a trial

I'm sorry but without more information this is a difficult question to anwer. Generally speaking though, if the ticket was received outside of NYC then your attorney can negotiate a possible disposition with the Prosecutor's office. If it was in NYC then your attorney would represent you at the traffic court trial at NYC TVB. Your best bet here though is to contact an attorney and speak with them about the specifics of your case. ... Read More

Will a bench warrant go away after paying late on speeding ticket?

Answered 4 years and 5 months ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
It would be appropriate to file something with the court that issued the bench warrant asking that the bench warrant be quashed, and attach a receipt showing payment.  If it is no0t quashed, a quick court appearance likely will resolve the matter. Most courts have a day and time for people to appear on bench warrants to get the case reset on the court docket.  Also, be aware that an 'unpaid ticket' will suspend your drivers license until the matter is resolved so getting the case in court resolved (i.e. bench warrant removed) is important so the DMV record ends up being accurate and you don't get arrested on the warrant or for driving while suspended. ... How Much does it cost to have a Lawyer represent you in an OUI case? Are there Lawyers that are willing to work with you Financially?

Answered 4 years and 6 months ago by Andrew Allen Popp (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
The cost varies quite a bit depending on the experience of the attorney, geographic area and even the facts of the case.  It can range from a few thousand dollars to over $10,000 in some cases.  Many attorneys will offer you a free consultation to evaluate your case and will quote you a fee after the fact. An 8 point violation can have a significant impact on your insurance, and there will likely be a high fine included with it. You don't mention where you got the ticket, but if you got it outside of NYC then you may be able to have your attorney negotiate with the prosecutor to reduce your violation to a lesser violation which will include less points, fine, etc. If it was in NYC please be aware that NYC Traffic Violations Bureau does not negotiate pleas. Instead, you can have your lawyer fight the ticket for you there at your traffic court trial. As far as how this will impact your parent's insurance, you will have to speak with the insurance company to look at your policy. With that being said it seems like you were covered by the policy at the time of the violation, and either way you were driving the vehicle so I suspect that it will have some impact on the insurance premium.    I hope this information is helpful. ...
