Can I fight this ticket

Save yourself a lot of time and the money. Hire an attorney to appear on your behalf to fight these charges and to set the matter for trial.

A traffic (FTA) warrant can be recalled without you having to appear in court. You should hire an attorney to have the matter set on calendar and the warrant recalled.

Can I get proff of my traffic violation from the cameras above the street lights?

Answered 9 years ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
My experience is that many traffic "camers" at stop lights do not record, rather they are there to detect traffic and modify the signal sequence as needed. But some are recording devices, especially in Denver. But they do not retain the recording for long and it is fairly quickly recorded over, so you woudl need to seek to preserve it quickly.  However, if you agree that you stopped past the stop bar at a stop light, I am not sure how the camera helps you if it exists. It might be better to look into whether the officer had sufficient "consent" to search your car.  A lawyer who reviews the police reports and hears your version can he;p you with that. ... Read More

I'm manitou springs ,does the court system give extensions in paying for speeding ticket and compulsory insurance.

Answered 9 years and a month ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
Most courts will allow for a payment plan to pay off fines and court costs.  Some will even allow a person to do community service work in place of paying money. I do not know if Manitou Springs does that ro not however.

When is it worthwhile to contest a citation for a red light violation?

Answered 9 years and 3 months ago by Nicholas Emil Froning (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
It can be adventageous to contest a moving violation solely for the purpose of keeping insurance costs down. Obtaining points on your license can make the insurance premium raise hundreds of dollars per year. So it may be worthwile.

How can i get a DUR after my right to drive was reinstated?

Answered 9 years and 3 months ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
I think to answer this a lawyer is going to mneed to analyze your driving record and see what is going on. It would not be possible to answer this question from the information currently provided. That said, it seems like the place this has to be straightened out is in Florida - where they say you have an outstanding traffic viiolation (but clearly is not you).  I would contact a lawyer in Florida OR contact Florida DMV and see what they require to remove this from YOUR record - i.e. what do they need to believe this outstanding ticket is not YOURS. ... driving record expungement

Answered 9 years and 3 months ago by attorney Christopher Patrick Biering, Esq.   |   1 Answer   |  Legal Topics: Traffic Violations
First, because infraction occurred in Georgia, that State's expungement laws would apply.  To the clearing of the traffic / moving violation.  In South Carolina, traffic offenses are not "expungable."   Second, insurance companies look at both DMV conviction and chargeable accidents.  The insurance company will look at the industry determination of fault, and the threshold crossed with the cost of property / or injury claims made.... Reg traffic points

Answered 9 years and 4 months ago by David B Harrison (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
It would be unusual for a judge to agree to reopen a case once it has been taken care of in Court. But you could always ask if it can be done (contact the clerk for the Judge and see if they will get your case back in front of the Judge). I doubt they will, but you could ask.  "Plea Bargains" in a case are normally offered by a prosecutor (not a judge). If there was no prosecutor in your case, then it was a state court traffic infraction and the judges have very limited power to do anything in those cases. If this is the case, the offer you got and accepted is the best offer you will get. ... Read More
