Not unless you have a husband willing to adopt the child. Then you could seek termination of rights as part of the adoption.

Annulment only works very rarely. A family law attorney in your community can tell you whether that is something that could be approved in your court based upon your circumstances. It works better if the other side agrees to an annulment.

If you mean by that, that the child has been adopted by another parent, then no. If you just mean that the NC parent has no visitation, then yes support would continue.

Can I apply for a green card without being sponsored?

Answered 8 years and 7 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
Other than the family based cases, asylum, visa lottery, and EB-5 immigrant investor, I assume that your question is more attuned to whether you can self-sponsor yourself through employment. Presently individuals are able to do so only if they are extraordinary in the field of endeavor or their immigration would advance the national interest. It is good to have a PhD, but under present law, it would not entitle you to an automatic green card. I do note that the Trump administration is attempting to change the immigration system to allow educated individuals like you to self-sponsor upon the attainment of 30 points. Whether the legislation entitled the RAISE Act will be enacted is questionable as it has unfavorable aspects to Democrats and other immigration proponents. But we will be keeping our eyes on it the same as you, I imagine. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Is there a law for guardianship that allows her to decide how her money is spent?

Answered 8 years and 7 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Child Custody
I am not quite sure how you have guardianship in the first place if her only disability is her eyesight. The reason the law is like this is because of countless cases in which a guardian (often a parent) misuses and helps themselves to the ward's money. You should sit down with the attorney who helped you obtain the guardianship and see if there are ways the strings could be loosened. If you did not get an attorney, then the whole thing may be fouled up and you need to find one to review all the paperwork you are relying on.... Read More

I was caught speeding 90 in a 40 mph zone. How much trouble am I in

Answered 8 years and 7 months ago by Susan Kozlowski (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
You are in trouble, for sure, but you will get past this, and it will be a ticket you will probably never forget.   Get an attorney to help you with this.   Do not pay the ticket and do not try to handle it alone - this is too serious and can have long reaching negative effects on your future driving privileges.  ... Am I not allowed to go to swimming lessons because my exhusband' mother in law is paying for them?

Answered 8 years and 7 months ago by Susan Kozlowski (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
I agree with you -- this is no way to co-parent, and it is detrimental and stressful for your daughter.  It will only get worse until he understands the effect on a child for this nonsense.     I suggest you consult an attorney who practices family law and discuss the best way to educate the father and develop an effective co-parenting plan.  I wish you the best... How do we find the Attorney for a person who recently passed away? I am his brother and need to find his attorney.

Answered 8 years and 7 months ago by Susan Kozlowski (Unclaimed Profile)   |   1 Answer
I think you might be on the wrong track.  You do not need to find a deceased person's attorney in order to probate his estate.  You might have another reason for finding your brother's attorney, but you do not need him to handle your brother's affairs.    What you should do is consult with an attorney you choose, preferable in or close to the county in which your brother resided when he passed away. That attorney will explain how the process works, and you can take it from there.   This is complicated and an attorney will relieve a lot of the stress associated with this sad time in your life.  I wish you the best.  ... If you have been legally emancipated, you should take the order with you when you apply for an apartment, housing, etc.. One of the difficulties you have in your situation is that folks may not want to rent to you if you are under 18, in spite of that order. There is nothing illegal about someone refusing to rent to you because of that. Hope fully you have persons in your life who can help you with this question, as it is mostly a practical life question as opposed to a legal one.... Read More

How do I file c case for negligence for my father?

Answered 8 years and 7 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Personal Injury
You need to talk to an attorney who specializes in medical malpractice cases. That consultation will typically be free, and the attorney can explain the process by which a claim is pursued. It is NOT something you can do on your own for your father in any fashion.

When does a power of guardianship expire?

Answered 8 years and 7 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Family Law
No such thing. A power of attorney expires when the person who granted it, meaning the person whose powers are being exercised, revokes it. An order of guardianship can ONLY be given by a judge, and it lasts as long as the order says it lasts, and if there is no date given, until the judge modifies it or the person whose powers have been taken away dies....
