Normally pre-trial diversion does not include a plea of guilty.  Pre-trial diversion normally is no finding of guilt with a time period to meet conditions of the agreement, which are normally just a payment and no furhter arrests.  If those conditions are met the charges are dismissed.  I would suggest speaking with an attorney if those are not the terms.  ... My mother's fingers were amputated. She's diabetic. I'm her daughter but not her legal guardian. Can I sue on her behalf?

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer
You potentially can hire an attorney on her behalf.  It may depend on your mother's mental state and if she can consent.  If she cannot cosent you may have to open up a guardianship to bring the claim.  Opeing up a guardianship or purpose of a lawsuit is not difficult unless other family members may disagree.  ... Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Medical Malpractice
It may be medical negligence.   An attorney would need more information to determine.  Including but not limited to the medical records.  There is a 2 year statute of limitations.  If you are left with permanent damage get your records and have an attorney review.  ... Read More

Is police entrapment

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Much more information is needed.  Entrapment is when an officer uses force, coercion, or trick to get someone to do something illegal they were not going to do without the actions of the officer.

HE is not KEEPING anyone under your scenario. Your daughter is a grown woman and has the responsibility one way or another. The real question is whether under Indiana law you can compel your own daughter to provide visitation to you with a grandchild in her custody. I was in an accident 6 months ago. The other driver ran a stop sign and hit me.. he was 16 and on a cell phone.

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Automobile Accidents
The other driver's carrier can be forced to provide certification of coverage.  You may have the ability to get additional coverage through your own underinsured coverage but have to take certian steps to do so.  You may think that resolving the claim for the $25k with the other driver and not using an attorney gets you more money in your pocket and that may not be the case.  Not only becuase of the potential underinsured coverage but also, if the $25k policy is not enough to make you whole you don't have to pay back certian 3rd parties, i.e your health ins., your auto medical payment coverage, etc.  The other ins. won't tell you these things.  Speak with an attorney asap. ... When can I get a Restricted drivers license?

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
You may be able to apply now for specialized driving privileges.  Also referred to as restricted license or hardship license.  This would allow you to drive at certain times -i.e to and from work.  You would need to file a petition with the court and maintain high risk insurance.  Speak with an attorney asap to see if you qualify.  ... Can I make a legal claim?

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You can but the question is should you.  That will depend on the specific facts and the nature of the injury.  Before you speak with anyone from the store or their insurance company speak with an attorney.  An attorney can tell you if you should pursue.

My fiancรฉ was arrested on a warrant that had been lifted 4 times while out of state. Is that legal? Any thing we can do about this?

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
More than likely the warrant was never lifted.  Indiana just did not want to extradite him so the arresting state released him.  He should have taken care of the warrant and the underlying issues the first time he was released.   The question now is if the judge was correct in the sentence.  You can get all the info together and speak with an attorney.  ... Can state police keep seized property if charges are dismissed from death of defendant

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
I assume the seizure was due to the allegation the property was used for criminal activity.  If so they must prove that fact to keep the property.  The fact that the charges were dismissed becasue the defendant passed away does not change the issues.  If the property is valuable speak with an attorney.  ... I was place on probation for a misdemeanor theft charge that I later stopped attending out of fear of going to jail

Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
The worst thing to do is not keep in contact with probation.  More than likley they have revoked your probation and a warrant is issued.  You need to speak with an attorney asap.  The attorney can look up the status of your case and decide how best to move forward.  Don't ignore this any longer.  The longer you wait the worse it gets.  Your best opportunity to get resolved is if you do it on your own before the court forces you to do so.  ... Answered 8 years and 5 months ago by Michael D. Babcock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Medical Malpractice
You have a work comp claim which I would suggest you have counsel for.  Also, there is a possible medical malpractice claim as well.  The work comp carrier should pay for any additional surgery/treatment required because of the stitches.  In Indiana you have a two year statute of limitations on the medical malpractice claim.  Using the wrong stitiches would be negligence the question would be the amount of damages.   I would suggest speaking with an attorney asap. ...
