Can I sue the funeral home for putting on my husbands death certificate that we were divorced at his death, and we are still married?

Answered 6 years and 9 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
The problem is not the funeral home but the insurance company. The death certificate is not the only document that the insurance company looks at to determine if your were married or not. I would contact the funeral home and ask them to write a letter stating that the death certificate was incorrect when it stated that you were divorced. Send that letter along with other documents establishing that you were married. If they continue to deny the claim, hire an attorney to sue the insurance company.... Read More

can my daughter break an apartment lease?

Answered 6 years and 9 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer
If she signed the lease agreement, then she is liable. If she did not sign, then she can walk away. Otherwise, you need to read the lease to see if there is a way for her to legally end the lease. If she did sign the lease, then she might go to the apartment management and explain the circumstances to see if they are willing to end the lease.... Read More

If a parole violation has already been filed, then it is kind of late to be thinking about that now. However, if no violation has been filed, you might reach out to your PO and talk about it with him/her.

is it legal for police to seize and put a hold on a vehicle for improper tags?

Answered 6 years and 9 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
Technically, they are suppose to seize the registration and/or license plate if it is knowingly displayed upon a vehicle other than the one for which it was issued. If they do this, then you could not drive the vehicle. They could have allowed you to tow the vehicle somewhere. They obviously thought that there were drugs in the car and when they couldn't find any, they were angry and decided to punish you. ... Can a trust be broken?

Answered 6 years and 9 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Trusts and Estates
To answer this question, there are many more facts that I would need to know in order to answer your question more throughly. Your children might want to consider hiring an attorney to seek an accounting of your sister as trustee as to where the money that was placed in the trust for the upkeep of the property has gone.  She money left in the trust, ie. $10,000, belongs to your children and not the trustee so she can not offer to "buy"  the house for the money left in the trust because this money already belongs to them.... Issue with car cosigner taking the car without permission and refusing to give the car back

Answered 6 years and 10 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer
Being a cosigner on the car does not entitle her to possession of the car. Right to possession is determine by the TITLE to the car.  If she is not listed on the title and it is only you on the title, then she has no right to possess the car and she has stolen your car. If you are both on the title, then each of you has an equal right to possession of the car. If she is the only one on the title, then she has a right to possession.... Read More

Answered 6 years and 10 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer
If you have not already done so, then you need to talk with him about it. It could be that he is having financial difficulty and can not afford to pay it. If you can not resolve it, the debt is your wife's. Ultimately, if you wanted to take it this far, you can sue him to compel him to pay it. Good luck!... Read More
