The last court order you have regarding custody, does it allow you to relocate without permission or notification to court? It sounds like you have standing to file for custody of the child. The young man will have to get proof of paternity through a DNA test if he didn't sign an acknowledgment of paternity when the child was born. If he's the father and you are successful in getting custody, he would be ordered to pay child support to you. He could also get a visitation order, but if you have concerns about him keeping the child overnight, you could argue for a non-standard possession schedule for him. If that is true, you will have to file a case called a Modification in Suit Affecting the Parent-Child Relationship. This suit will allow you to ask the court to let your son live with you. In the meantime, you should try to get your son for as much extra time as the sister will allow. Just start out with an extra night here and there and then keep building up as much time as you can. When you file for the modification, you'll be able to show that you've had your son all that extra time. As a joint managing conservator, you have equal rights and duties concerning your child. The mother is likely the joint managing conservator who has the right to determine the primary residence of the child. This means the child lives with her and you have a possession schedule for when the child stays with you. Texas doesn't really use the word "custody" so I'm not sure what you mean when you say "50/50 custody". You are likely referencing Joint Managing Conservatorship. Take time to go through your order and notice what it says under each heading so that you are clear on your rights and duties concerning your child. Even if the mother was appointed as sole managing conservatorship, you still have a right to see the medical records. If the mother is hiding them from you, you will have to try to seek the records by investigating throught he providers for the records you do have. You can ask the attorney general or the domestic relations office to file for a change of status in your case since you've had the children for more than 6 months. You don't have to get a lawyer. The AG or DRO will file the suit and you can appear pro se.
