Hey Alicia, thank you for calling and sorry we couldn’t talk at that time. You will need to file for full custody in the county you are currently residing in. How did you move to different county? The last court order you have regarding custody, does it allow you to relocate without permission or notification to court? Without knowing the full details of the case it’s advisable as a general rule to keep your contact information correct with the courts and than initiate custody modification in your new county requesting full custody. You will need to serve your ex (the kids father.) Second topic, Name Change. You should consider the name change when and after you are granted sole legal and physical custody. Just to make the litigation process easier. Texas attorneys are really expensive. I couldn’t believe most of them charge as high as $250 for a consultation. If that is true, you will have to file a case called a Modification in Suit Affecting the Parent-Child Relationship. This suit will allow you to ask the court to let your son live with you. In the meantime, you should try to get your son for as much extra time as the sister will allow. Just start out with an extra night here and there and then keep building up as much time as you can. When you file for the modification, you'll be able to show that you've had your son all that extra time. You should read your court order very closely and determine when you are supposed to have possession of your child. In Texas, there is joint managing conservatorship. As a joint managing conservator, you have equal rights and duties concerning your child. The mother is likely the joint managing conservator who has the right to determine the primary residence of the child. This means the child lives with her and you have a possession schedule for when the child stays with you. Texas doesn't really use the word "custody" so I'm not sure what you mean when you say "50/50 custody". You are likely referencing Joint Managing Conservatorship. Take time to go through your order and notice what it says under each heading so that you are clear on your rights and duties concerning your child. Even if the mother was appointed as sole managing conservatorship, you still have a right to see the medical records. If the mother is hiding them from you, you will have to try to seek the records by investigating throught he providers for the records you do have. You can ask the attorney general or the domestic relations office to file for a change of status in your case since you've had the children for more than 6 months. You don't have to get a lawyer. The AG or DRO will file the suit and you can appear pro se.
