what to do if i found a spider in my potatoes?

Answered 9 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Youcan try making such a claim and make sure you keep the spider. As a general rule, especially with Wal Mart, if the spider wasnt noticed REALLY close to the time of purchase, you will most likely have to decide ifyou want to spend the money litigating a case against Wal-Mart as most lawyers wont under such facts unless the "adulterated food" case is VERY clear. ... In 2014 I purchased a 2014 Toyota and traded in a BMW for about $15000, I am paying for more than double what the car cost.

Answered 9 years and 11 months ago by Fabiola E Ruiz-Doolan (Unclaimed Profile)   |   1 Answer
This is a very common practice. What happened, in this case, is that they added the balance you had in your 2014 Toyota and added to your new BMW balance. You probably have a high-interest rate too. When I see cases like this the consumer has between 14 to 20% APR.   My suggestion in your case is to go the Credit Union and try to refinance the car.  That way you can negotiate down the interest rate.... dealer damaged vehicle while performing repair

Answered 9 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
You'll need to have the engine torn down and see what caused the damage to the engine with an independent expert. If it was the repair shop you may need to sue them or make a clain against thier insurance. The fact that the vehicle was driven before the repair does not mean that there was not engine damage already and this needs to be addressed. ... Read More

can I sue someone for an issue from 14 years ago?

Answered 9 years and 11 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer
It appears that PayPal got a judgment against you years ago and executed on your present account. Please check ASAP. You should have done the same against the person that did not pay you. How much money was involved ?  You are now too late. You may have an issue with PayPal if they do not have a judgment against you or if you were not properly served. Ed Dimon... Read More

You must document in writing all that happened and provide to the manufacturer and to the shipper. You must explain in writing how the furnace was damaged. You must alert your insurance company for your home. You must be detailed and factual. You will be successful. You can sue in Small Claims Court if vendors are local. Ed Dimon... Read More

I took my vehicle to a shop to get a tune up last Monday and when I picked it up from the shop my engine light was blinking and the car was putting and jerking as well as it kept shutting off every time I stopped. When my husband took the car back to the mechanic, the mechanic said that because he did the tune up "it intensified another issue that was wrong with the vehicle" but there wasn't anything wrong with our vehicle prior to taking it to him. He placed it on the lift looked at it and said his work was "done correctly" and that "further work would need to be done on the vehicle to get it running properly again". My husband brought the vehicle back home and the next morning we took it to another mechanic and he said that the wires for the tune up were crossed "wires 1 and 2 to be exact". he wrote this on our receipt and I took the receipt back to the local repair shop and asked him for a refund and he refused.Do I have a case against him being that he deliberately crossed my wires? Because of his mishandling of our vehicle we were forced to take it to another shop and pay them for repairs. Repairs resulting from his error to begin with and his neglect when he looked at it the second time and said he "performed the tune up correctly". He is an authorized repair shop a tune up should be a fairly easy job for him to perform therefore he should have known the job was done incorrectly when he gave it a second look if he looked at all. Is there anything I can do to get my money back from him? are there any laws in the state of New Jersey to protect us from this type of fraud?

Answered 10 years ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer
You should carefully gather your evidence in writing and present to the first repair shop. Put their specific response in writing- what was the actual problem ? Check the answer with the second repair shop and put answer in writing. You can then she in Small Claims Court. Ed Dimon

You should win this case if you gather the evidence and present the evidence first to the seller in detail. You should do this in writing. If you are not successful, you can sue in court. We can help you with the latter but the legal costs have the potential to match the cost of the horse if the seller will not settle. Please call if you need help. Ed Dimon... Read More

Restraint of Trade

Answered 10 years ago by attorney Mark Tischhauser, Esq.   |   1 Answer
As a consumer you generally do not get to dictate how a manufactuer sells its products or the terms of its contracts with its dealers. If there is discrimination you would have to show some scheme or impact on a protected class.

Most counties have online dockets so you can see the details of the alleged judgments.  I suggest looking there first.  If it's a question of mistaken identity, which happens fairly often, that can usually be cleared up with little trouble.  If indeed there are judgments, that needs to be explored further to either contest them or consider a bankruptcy to discharge them.   I strongly advise speaking to debt relief counsel and I offer a free initial consultation. ...
