First, this is a commerical issue and as such you cannot possibly use internet blurbs as a substitute for actually hiring legal counsel or corporate counsel. Second, such things are defined by the terms of the "warranty" itself. The problem here is that the expense of actually resolving this issue is likely going to be moe than the repair cost of the TV. Not sure how this account got sent to Aarons unless there was some sort of buy out, but in theory one or the other may be obligated to fix the TV.

If the company was selling blacklisted or gray market phones without informing the customer, you certainly may have the right to sue. You may not be allowed to sue under consumer fraud laws however, because this seems more like a business to business transaction than a business to consumer transaction. You can contact the Attorney General certainly. And although you may not be able to sue under NJ's Consumer Fraud Act, you can still probably sell under a general cause of action for fraud, just not under the CFA statute.... Read More
