How long does the state have to charge someone for a theft charge that has not been arrested?

Answered 8 years and 5 months ago by Mr. Robert Jason De Groot (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
It depends upon the degree of the crime. If it is a misdemeanor, it can be up to two years, if a felony up to three years.

Some offenses carry with them automatic license suspensions. If that is not causing a suspension, then it might be that whatever plea bargain or sentence you entered into almost certainly included court costs and restitution, non-payment of which can lead to suspension of your driver's license. You can check the status of your driver's license at https://services.flhsmv.gov/dlcheck/ Once you know why your license is suspended, you can either seek a hardship exception to allow you to drive for work purposes, or work out a payment arrangement if your license has been suspended because of non-payment. Good luck!... Read More

Could my case be dismissed because this my first offense and I went to juvenile?

Answered 8 years and 5 months ago by Mr. Robert Jason De Groot (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
I would need to know a lot more than you have written in order to answer your question. For instance, I would have to read the police reports and statements of any and all witnesses, and I might even have to take the depositions of some witnesses.

If I got arrested for weed and the amount that the officer put was inaccurate, could that help me in my case?

Answered 8 years and 5 months ago by Mr. Robert Jason De Groot (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
It depends upon the facts. Once I had a case that was brought as a felony because the cop weighed the pipe along with the weed, and that was over 20 grams, but the lab came back with a result that the weed was less than 20 grams. So, it helped because it was reduced from a felony to a misdemeanor.... Read More

Will I have any problem at the airport when I fly out of the US if I have felony probation?

Answered 8 years and 6 months ago by Mr. Robert Jason De Groot (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Your facts are confusing. I do not know whether you already have a warrant out for your arrest or not. If so, you should face that warrant. Otherwise, it appears to me that you are trying to get legal advice about how to break the law. I cannot give you advice about that. You have many questions, and it would be best to actually go to see a private criminal defense attorney for a full discussion.... Read More

Do I plead as a first timer since my record is clean now?

Answered 8 years and 6 months ago by Mr. Robert Jason De Groot (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
You need to get an attorney to look into the facts. Just one of the things us private criminal defense attorneys do is to make sure that the state has a case. If they do not even have a case against you, which happens a lot, you should fight the case. A criminal record can affect you for the rest of your life. ... Read More

Grand theft, a 3rd degree felony which carries up to five years in prison. She needs to get a private criminal defense attorney. Depending on the facts the case might go smoothly, but what I fear for clients nowadays in more geared at after the case is resolved, knowing that if the client violates probation, the entire sentence of 5 years can be imposed.... Can I live in the same house as my father if he is a convicted felon and I own firearms?

Answered 8 years and 6 months ago by Mr. Robert Jason De Groot (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
I think that it would be best to store them elsewhere. The reason that I say that is because of a case that I have had in the past. A brother had left a box of shotgun shells in a desk which was pushed up against the wall, facing the wall. The defendant did not know the shells were there but was charged criminally, and it took quite a bit of negotiating to get the state to drop that charge. So, why even have to negotiate when it can be a mandatory minimum of 3 years in prison for your father? He can get his right to bear arms restored if it has been more than 8 years after to completion of the entire sentence.... Read More

So, the state might be successful in a criminal prosecution, and restitution could be awarded. Contact the victim advocate at the local state attorney's office and stay in touch with them.... You need to make an appoitment with a criminal defense attorney in your area.  I would not talk with anyone else but him or her until you meet.  If someone claims theft there will very likely be an oficial investigation by the bank and the police.  Do not talk to them without seeing an attorney.  It will be worth. Never assume that if you just tell them the truth they will not charge you or believe you.   Whatever county you are in look up a board certified criminal defense attorney.  You can use lawyers.com for that or martindale.com...
