1st offense as a 17 yr old minor. I stole $350 from Walmart

Answered 9 years and 10 months ago by Anthony Van Zwaren (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
There is no way to answer this without consulting with a Virginia attorney. The fact that you may live in New Jersey is not relevant, the crime was committed in Virginia. I would suggest checking for criminal law attorneys in Virginia in Lawyers.com and find one located nearest to where you have to go to court. Or post this question on the site for Virginia attorneys.... Read More

Petty Theft Misdemeanor - Out of State

Answered 9 years and 11 months ago by Anthony Van Zwaren (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Even though a conviction may be expunged (every state has its own timetable and requirements) it would still be encumbent upon a person being admitted to the Bar to report it. However, it is possible for the Bar Examiner to waive a minor offense. I think attempting to hide it, even if it were expunged, would cause more problems. But that is my opinion. You can call the Attorney Ethics hotline in NJ, they may be able to assist you. The number is listed on the link I am providing. http://www.judiciary.state.nj.us/oae/ethicshelp.html... Read More

can an attorney knowingly lie

Answered 9 years and 11 months ago by Anthony Van Zwaren (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
I don't see where the attorney lied. If the client gives information to the attorney that is inaccurate, it doesn't sound like a lie. And an attorney is not required to give legal information to an adversary although they are also not ethically permitted to knowingly mislead someone. But even by your own description, I do not see anything that remotely describes a knowing lie.... Read More

I missed a court date and got it reschedule but im worried about going to jail, what should i do?

Answered 9 years and 11 months ago by Anthony Van Zwaren (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
I guess this was on the Palisades from your description. My advice is to get an attorney. The attorney can usually get you a new date and find out if you have to post bail for the missed court appearance. So that is the best way I think of to avoid being picked up on a possible bench warrant.... Read More

my bf is a sex offender on megans law

Answered 10 years ago by Anthony Van Zwaren (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
I don't think there is any connection to your receiving a disability check. However, having a megan's law offender may infringe upon rights to public housing, but I believe it depends upon what tier the person was sentenced on under Megans Law. I believe under HUD regulations, you wuold have to list a new occupant on your assistance program so the fact that your bf is on the registry would have to be mentioned or else you could be hiding information. But I don't think being on the list automatically disqualifies someone. A person on the registry for a minor offense (say like a teenager found guilty of sexting) as opposed to someone who commits a serious offense like rape or child abuse). But a violation of Megans law can provide other problems if you have young children or get pregnant that may lead to the Division of Child Protection and Permancy getting involved.... Read More

False criminal charges by an ins co

Answered 10 years ago by Anthony Van Zwaren (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Based upon what you wrote you have a right to sue the person who made the false report provided that you are iwthin the statute of limitations which is one year for libel or slander and two years for false imprisonment or false arrest. You should definitely consult with an attorney. You may also be able to file a criminal complaint for filing a false report however, I think that it would be difficult to get a prosecutor to puruse a criminal case. I am providing you with a link that might show you what you would have to prove in a criminal court assuming you got to trial. http://www.judiciary.state.nj.us/criminal/charges/falsrep.pdf... We do these cases every week and we are successful because we give the judge and prosecutor a record which supports the dismissal of the charges. We provide the medical reports, the counseling reports, the statements of the witnesses, etc. We then put all of this on the record in court. The process is complete and successful.
