The divorce decree does not affect the status of any loans.  If you fail to pay or your x fails to pay a loan that they signed for, the lender will seek recovery from whoever signed for the loan.  The only recourse is to file a Motion for Enforcement in court, but if they do not have the resources to pay, then you will not recover the money anyway.... You should supply the therapist with a copy of your Final Decree of Divorce showing that you have the right to receive medical information and to make medical decisions.  You should send your request for the records in writing with a copy of the Final Decree via certified  mail return receipt requested.   You should also request to know the reason that she refuses to release the records. The next step would be to contact the licensing board and see if they can assist you in obtaining the records.... Read More

You need to speak with an attorney.  If you and your husband lived in the house and you continued to live there you have a homestead interest which could give you a life estate in the house.  This can then stop the sale.

Should my friend pursue custody at this time?

Answered 13 years ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Family
This would seem the ideal time to file. It will be very difficult to establish all that is necessary without an attorney. If you want support you will need to establish paternity for the youngest child. You will probably need support from the father so that will need to be litigated.

Answered 13 years ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Family
This would seem to be a case where there is danger to the children and Child Protective Services may help. They can be difficult to deal with so be prepared. The children are not assured to go to you if they are removed. If you are correct that she is violent and it endangers the children you may be able to get sole custody.... Read More

How can i give my rights up as a father? How much would it cost?

Answered 13 years ago by attorney Mr. Kenneth G. Wincorn   |   1 Answer   |  Legal Topics: Family
You cannot relinquish your rights without an agreement with the mother. Once you father a child you have a responsibiity for support until the child reaches majority or leaves home as an independent person. There are other ways that support may be due even after reaching 18 years if age. The determining factor is the childs needs, not those of the parents. Support is based on the ability of the parents to pay. To contest the amount of support you need to prove a change in circumstances that limits your ability to meet the court ordered amount that is currently set.... Read More

It is extremely difficult to get sole custody unless you can show that the mother is unfit if she has initial custody. Joint custody is the most common type and the court has to decide who has the most time to spend on raising the child, best home environment, support from relatives, financial stability and etc. The list is extensive. Cost of litigation is a major issue also as proving that there should be a change of custody. If you have the ability to fund a custody battle, see a specialist who can evaluate your case. A second opinion from a lawyer is valuable just like a second opinion from a doctor.... Read More

how can the father of my child sign his rights away?

Answered 13 years ago by Helene Thaissa W. Bergman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
You cannot make that decision for your daughter, she is not here yet. Next, father cannot walk away.  Someone has to want to step into his shoes. You could leave him off the birth certificate and never pursue child support. When you need the money, it will be more difficult, but can be done.  But if you wait too long, will get only back four years. You and the baby need the money, are entitled to the money and have a legal right to the money. He does not want to pay?  His problem.... Read More
