Answered 12 years and 2 months ago by William L. Sanders (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Employment
yes, you may sue any one for any thing, even a frivolous or false reason. No one will stop you from filing a suit. But will you win. Likely not. You will be required to prove actual damages, no speculative damages, no wounded feelings, etc. The law does not address every wrong that we may feel in life.... Read More

Can an open account and bankruptcy affect my job at the company?

Answered 12 years and 2 months ago by William L. Sanders (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Employment
I know of no law that prohibits this. This would be determined by company policy. I can not imagine a collection agency hiring a debtor that they are pursuing, but I know of no legal reason why they may not do so. Other than the Fair Debt Collection Practice Act, I know of no regulations applicable to collection agencies. They are not a licensed profession.... Read More

You may report this to IRS. They call this mis-classification. You likely should be W-2, and failure to do so has serious consequences for the employer. They are liable for your matching social security, your Medicare payments, etc. That being said, reporting this could cause you to be discharged. It is your call. Perhaps you should find a job with a real employer?... Read More

I am at will employee and my boss will change me from management to a class reducing my rate of pay can I file for unemployment?

Answered 12 years and 2 months ago by William L. Sanders (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Employment
Yes, you may file a claim for unemployment. Any one may do that. But, will you win? Likely not. GA DOL would have to find that you were downgraded substantially, and that you were done so through no fault of your own. And that a reasonable person would have quit this job under these circumstances, rather than finding another job and then quitting. GA DOL rarely does that.... Read More

You wrote the question in such a way, any one would agree with you, if they accepted the conclusions as you state. But, a lawyer should never answer such a slanted question. A lawyer should never comment on this without reading the actual document and making his own independent determination of the facts that you state with such forceful prejudice.... Read More

How do I go about changing my insurance company from where I work?

If you mean Affordability Health Care Act, AHCA, (also known as Obama Care) when you say " I qualify for ACA" you should rethink this. Generally, one does not qualify for Obama if they have coverage at work. Obama is for those who can not get insurance, not for those who want it instead. If you drop your company health insurance, you likely will end up with no insurance at all. I think your employer is right about open season. Which would mean you can not get back on till next open season.... Read More
