Can I still fight for my employment case?

Answered 10 years and 10 months ago by William L. Sanders (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Employment
I do not know what this means: DUA Are you in GA? I only answer GA questions. If you are in another state, resubmit your question, and disclose what state you worked. The law you quoted on intentional acts is the law in GA. I often get reversals in court based on this very issue.

In GA, your sole remedy is to collect unemployment, unless you can prove grounds for illegal discrimination. Not all discrimination is illegal. In GA, it is limited to your EEOC grounds: Race, age, sex, national origin, religion, handicap. If it is not on that list, it is not illegal.

What can I do if my boss threatens me? How?

Answered 10 years and 10 months ago by William L. Sanders (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Employment
I do not think that is an illegal threat. Perhaps you should take him seriously and learn to be more cooperative at work. That is why they call it work. Do not fight a battle where you have no stake, it will cost you your job.

Is there a way to clear my name before I get placed on the caregiver misconduct registry?

Answered 10 years and 11 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Employment
This does not sound like a Wisconsin law question. But wherever you are, it is very likely that any government department or agency maintaining such a registry gives you an opportunity to appeal from the decision, or to challenge the facts in a report. Check with a lawyer who does a lot of administrative law in your state, or call the agency and ask to speak to their legal counsel. Good Luck.... Read More

Are employers responsible for the employees who are asked to come in early during a snow storm? How?

Answered 10 years and 11 months ago by William L. Sanders (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Employment
If you are asking: May an employer may be held liable to injuries to their employee, who was injury while on the way to work, during an ice storm? If that is your question, I do not know the answer. I suspect they have no liability at all, and, if there is any liability, it would be under workers comp law. But, this type of injury is the type of case that most PERSONAL INJURY lawyers would be glad to discuss with you, free of charge. This how they make their money. I suggest you contact one of them for some free advice that you may rely upon.... Read More

If I am 16 and receives social security, can I still work an and receive it?

Answered 11 years and 3 months ago by Jack D. Longert (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Employment
Yes, you can. However, you should be careful how much you earn, and the rules are different for the amount your benefits would be affected depending on whether you get Social Security Disability benefits (SSDI), survivors benefits, or Supplemental Security Income (SSI), which I assume is what you are getting if you are getting benefits for disability. You should consult a benefits specialist or attorney familiar with these programs.... Read More

Is an employer required to give terms of paid suspension?

Answered 11 years and 6 months ago by Timothy Steven Gilpin (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Employment
I?m not sure where you are from and sometimes there are differences in state laws that affect the employer/employee relationship. In Oklahoma, an employer does not have to give an employee the reason(s) he/she was terminated from a job. By terms of a suspension. I am unsure what you mean. The reason for the suspension or the length of it. It also matters how many employees the employer employs. Over a certain number and different federal laws apply.... Read More

What are my rights after I was wrongfully terminated?

Answered 11 years and 10 months ago by Atty. Richard F. Rice (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Employment
It seems that your injuries were not work-related so you only have whatever rights are available under your employer's policies and any law that might apply but an attorney would need complete information and documents to evaluate your situation. Did my company unjustly denied me the $4200 I earned in commissions?

Answered 11 years and 10 months ago by Walter H. Bentley (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Employment
If you have interpreted your contract correctly your company has incorrectly withheld your wages. That is against the law. You need to consult with an attorney who practices employment law. They can properly interpret your documents to ensure that there are not areas of your contract that you may not recognize giving your employer an "out" I hate to see people work hard only not to receive the money owed to them.... YES. That said, you can be fired for wearing a blue shirt, and nothing at all. California is an 'at will ' employment state. If the employer no longer has a 'will' that you work there, you don't work there any longer.

Can I be fired for being routinely late to meetings?

Answered 11 years and 11 months ago by Charles Richard Perry (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Employment
I assume you are an at-will employee. Under this assumption, you can indeed be terminated for being regularly late for meetings or any other reason that is not unlawful (e.g., discrimination based on race, gender, religion, et cetera). Even if you could only be terminated for cause, being routinely late for meetings could in some cases constitute "cause" for termination. Most employees in California, however, are "at will" and fall within the first paragraph above.... Read More
