Florida has a statutory requirement that must first notice the publication so that it can print a retraction   Why anyone would not do so immediately is beyond me unless the person was more interested in a law suit instead of correcting the error in publication

I think the pertinent question is "what is your place of business" that you are waving his entry fee to and what do you do for a living? Depending on that answer, there may or may not be damage to your reputation, and assuming there is you would need to decide whether its worth spending thousands of dollars on legal fees to sue him over his comments, knowing you might not see any money unless he wins the lottery. If so - then you simply need to hire a lawyer at an hourly rate/retainer and  take him to task. ... Read More

Not sure what the question actually is. While there is a threat - there is no action and defamation by definition described.

You will most likely need to just invest the money needed to file a lawsuit and go from there. Most such cases don't get resolved with casual discussions unless there is public retraction

It hard to deal rationally with nut bags. You may have to spend a good deal of money on seeking enforcment of the stalking issue in the state she resides in. You may also want to hire a psychiatrist as an expert to see how they think you should handle this based on her psych profile. Sometimes, responding to such people is the WORST thing to do. ... In theory this would be a malpratice case if negligent and likely some other form a case if done intentionally as you allege. Bottom line is such a case would rarely be a contingent fee case and you would need to willing to spend money out of pocket to address this issue effectively for a variety of reasons. ... Read More

Its imposisble to really respond to this other than, you need to REALLY be satisfied that the current lawyer is not getting the job done or that you truly want to change counsel. Other than that, make sure you have another lawyer willing to take the case first, lest you find yourslef with no lawyer. As a lawyer than routinely handles defamation cases, I can tell you that there are not many lawyer that do so. ... Read More
