Unless you can get access to the video tape at issue or a "confession" from the corporate office that you were misidentified, you will likely be spending thousands of dollars in legal fees suing the store and the manager to get to the bottom of the issue. If thats in your budget and something you want to pursue it can be done - but you wil lhave to show that they made such accusations falsely. ... Read More

Sure - when YOU pay the $200,000+ plus in student loans and 7 years of schooling it takes to get a law degree. THEN you get to demand the services you complain about for free. So, until then, if you want to HIRE lawyers on cases where the lawyers won't take the risk of not getting paid and expend thier money on costs of litigation with a "contingent fee" then you get to hire then in the traditional fashion, you pay a retainer and an hourly rate for the work, just like you do mechanics, CPA's, handymen, Dentists, plumbers, A/C guys and literally everyone else in the world. So - the "balls" test actually lies with YOU as a starting point to make the finanical sacifices needed to address the claims you want to make. If your response is anything other than a willingess to sell off everything you own to fund the litigation you want to start, then the system doesn't need "justice" reform it needs "people" reform. Lawyers no more 'put themselves in the shoes of clients" any more than you do to give away free services or products not any other profession to that end and expecting otherwise because you need and they have, is about as unrealistic as me expecting a general contractor to build me a wonderful house at cost, and then only if I like the result, simply because they can and I want one. So - that aside - what you likely need to do in regard to what seems to be a defamation case - is to hire a lawyer at an hourly rate to review your facts and situation and provide an actual researched opinion. If you want to proceed from there - then you know what you are getting in to. ... Read More

What you describe may well amount to defamation, especially the allegations of criminality. HOWEVER, the idea that you have no idea about your husbands business and his allegedly illegal contracting work, is a likely a stretch. IF he is charged or convicted of such, truth is clearly a defense to such allegations and that can be probelmatic from a civil lawsuit perpective. That stated, at this point you will likely need to do a barrage of C&D (cease and desist) or retraction letters possibly followed up with one or more lawsuits to address the damages. Unfortunately, such cases are not handled on contingent fees, with rare exeption, so you will need to plan on spending several thousand dollars on hiring a lawyer to intervene. ... Read More

Yes, you can be sued because one man's truth is often the other's lie. Anytime you publish disparaging or accusatory things you need to equally be prepared to back up everything stated and to bear the burden of the fight you may invoke.

Be careful what you ask for as you might get "justice." Just because you were relased RoR and claim innocence does not make it so, nor doe sit make you gulty. If the press is reporting accurately what was alleged by law enforcement there is no claim there. If there was ANY criminal conduct issue or you have a past, then its hard to damage an already ruined repuation simply with notoriety. Equally complaing you were accused to drug dealing fentanyl when it was really crack or oxy pills, is equally not a compelling case. That you haven't had the charges dismissed or a jury acquital pretty much eliminate reputatonal injury claims.... Read More
