This is simply a matter of whether you want to spend the tens of thousands of dollars likely necessary to fight this fight with the daughter having POA. If not, then you are simply an affectionate room mate in the eyes of the law and thats the end of that.

Unless you are n the BOD, why do you care about the details of what the bad board member can or cannot do or what "evidence" can be considered in a recal proceeding? If you ARE on the board, then this question can only be answered by the lawyer representing the board and familiar with the procedural requirements for a recall. ... Read More

Hmmmmmm there is OBVIOUSLY something else goin on here as these facts and the victimization make ZERO sense. That said, if the debt was fully paid, its hard to understand why all of this went on, especially since it should have ended the next day when you returnd and paid your tab. Now is where you respond with "well wha ha happen whuz....". Regardless, this may be a collections practices violation at several levels if what you are saying is actually and accurately true. You should consult with a consumer lawyer in that regard if you like. ... Read More

Posting a public record of you called "doxxing" is not defamatory nor inherently actionable. Depending on the names or other statements made, there may be some actionable comments to support a lawsuit. Such cases are typically NOT handled by lawyers on a contingent fee so be pepared to pay legal fees out of pocket for a such a case. ... Read More

Not likely - disagreeing or being offended does not make the other persons filig a complaint malicious nor defamatory. It would require much more like evicende of an ongoing personal vendetta unrelated to the teaching environment or such. Also such cases are typically NOT contingent fee cases so you will have to bear the expense of hiring a lawyer out of pocket. ... Read More

ADA health danger apartment rental Claim / defamation libel and slander claim

Answered 8 years and 8 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
Not sure what you are asking since your description of the events is not very coherent. It appears that there was an eviction because somebody refused to let manangement into the apartment to provide a treatment. If you are not on the lease, then you have no right to stay at the apartment.... Read More

Possibly. It will depend on the details and whether you want to spend the money to hire a lawyer to take such action for you. These are not typically cintingent fee cases like car accidents.

You will probably need to hire a lawyer and maybe a computer expert to track down and ID of the person and then decide what action to take from there. Such cases are expensive but often necessary to vindicate the company reputation which can cost far far more in lost business.

Because you have no idea what you are actually saying or doing from a legal perspective and because an claimed victim letter saying "stop it!..." will usually be laughable to the claimed offender, or worse make threats that you can't or wont back up like "if you don't stop the conduct I will hire a lawyer and sue you! and for punitive damages and everything you own!!!!!...!!!!" I can't tell you how many defamation consults I have had where they intimate legal action AND THEN when whey realize the cost and that lawyer wont take defamation cases on a coningent fee, are left looking impotent and stupid which often emboldens the other party to ramp up the issues even more. ... You can hire any lawyer you want send such a letter - its simply a matter of spending the money to do so. Be aware that C&D letters in romantic disputes often do little more than drive the other person to be more sneaky. Youmay need to either simply file suit, at a significant legal expense, or find a means to disangage from interaction with him. ... Read More

I'm not sure what your question is but we would have to look at what the agreement entailed as far as the use of his name and likeness.  If there was damage caused to his reputation he may have a valid claim for defamation.  If he has not been paid what was promised that sounds like a clear breach of contract claim....
