" I spoke to progressive customer service and she stated that it was a common practice of progressive underwriters to falsely report information on clue reports to agents in order to charge higher rates and premiums"..........Unless you actually have that in writing, get an affidavit fro mthe CS rep, or a lawful recording no one will ever believe that story true or not. That stated, getting a lawyer to take such an issue on a contingent fee absent that will be unlikely. You may have to pay a lawyer to pursue such a case at the outset and possibly convert to a contingent fee if there is evidence to support your claim. ... Read More

Thats because every client thinks such cases are "open and closed" when the lawyer is expected to pay for all the legal fees and costs out of pocket and the client has little or no financial risk. As a lawyer that actually handles defamation cases, they are typically expensive to litigate and often very complicatd combative cases given the emotional issues. If you are willing to hire a lawyer where they are paid by you (the traditional wayy - not the car accident % way) you will find many more lawyers willing to handle such a case. ... Read More

Defamation

Answered 8 years and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
There are a number of options all depending on who "they" are. You will likely need to retain an attorney, typically with an hourly rate and retainer, to start addressing such issues. Waiting and seeing what happens is generally a poor choice.

LOOKING for defamation Atty

As a lawyer handling defamation cases - this is not really a defamtation case. Its more likely some form of "civil rights" or "malicious prosecution" type case. This hopefully has some form a video component as absent positive third party witness testimony such a case would be difficult and expensive to litigate or try. ... Read More

Libel cases are difficult to prove and expensive to prosecute. We could have our private investigator determine what could be proved. This would not be expensive. Maybe $1000. You could then decide if you wanted to proceed. The Retainer would be $15,000 if there was no trial. Ed Dimon, Esq.... Read More

Answered 8 years and 7 months ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
Yes. You can sue for defamation. Defamation is the act of publicly making or distributing a false statement of fact about another person or business. The defamatory statement is libel if written and slander if spoken. You have a two year statute of limitation.

grounds for defamation

Answered 8 years and 7 months ago by attorney Kirk J. Angel   |   1 Answer   |  Legal Topics: Libel, Slander And Defamation
Probably not.  Opinions, even false, wrong, mean, or over-the-top ones are not defamation. Only factual statements.
