If the comments that were posted are false then that is defamation per se, since it regards your son's ability to to his job.  However, if the comments were true then truth is a defense to a defamation claim.  He may or may not be able to get them to take the comments down, but he could sue for monetary damages.  Hope that helps!... Your company policies and procedures manual would need to be reviewed, as well as any documents pertaining to your "uplines" to look at that relationship. Unless he is a minor, your son, not you needs to be addressing such issues with lawyers. Especially since there seems to be a great deal of discordance with the employer inlcuding "working off the clock issues." YOu have Google lawyered yourself into a tizzy- as shown by the regurgitation of "qualified privilege". Don't do that as you will make things get out of control quickly. There is generally no privilegeor privcy you enjoy relative to an employer telling people of your termination. You DO have the right to not have people defame you by FALSELY spreading lies about the issue though. If by example, you were fired becaue you came in late and you can prove managers told people you were stealing,there would be an issue. You would probably have a hard time bringing a claim against the Boys and Girls Club because of the state's over-arching policy to protect children. People who work with children have a duty to report suspected child abuse or neglect. If those same people could be easily sued for defamation, it would be impossible to require mandatory reporting of suspected abuse or neglect. If the issue comes up, you can show the CPS records that show there was no abuse or neglect found in the case. We actually handle a number of these cases. Typical these are social media/internet defamation/tortious interference cases. To be clear they are NOT contingent fee cases but are handled on a retainer/hourly rate. The key is to be sure that the business wants to invest several thousand dollars up front to take the offender to task. If the answer is no, whether through lack of funds or not wanting to have the expenditure, then pursing such a lawsuit is simply not feasible.
